<br />construction contract documents have been authorized by the CIty to be competitIvely bid <br />without written consent of the City and the Engineer and with notice to the Contractor. <br /> <br />1.8 ADDITIONAL SERVICES/CHANGE IN SERVICES <br /> <br />1.8.1 Since the Engineer's compensation is a fixed fee for Basic Services, including minor <br />deVIatIons from those described In this Agreement, compensation to the Engineer for Additional <br />ServIces will only be for substantial deviatIons from the scope of services described in this <br />Agreement. The Engineer will submIt a wntten estimate of fees to the City and obtain the CIty'S <br />authonzation before initIatIng any addItional services. The following are specifically considered <br />addItIonal services: <br /> <br />a) Services related to procurement or management of thIrd party contractors other <br />than testing, inspectIon and survey firms. <br />b) Services related to warranty claims, enforcement and inspectIon. <br />c) ServIces for the investigation and analysis of contractor claims; preparation of <br />reports on contractor claims; provision of professional claims analysIs servIces; <br />partiCIpation In litIgation or alternative dispute resolutIon of claims. <br />d) PreparatIon for and serving as a witness in connectIon with any public or private <br />hearing or other forum related to the Project. <br />e) Services supporting the CIty In public relatIons actIvitIes. <br />f) Design and engineenng servIces for the review of, or the preparation of drawings, <br />specifications and other information for contractor or City inItiated change(s). <br />g) Power supply upgrades and emergency power evaluation. <br />h) The provIsion of additIonal contract documents. <br />i) WWTP improvements requIred as a result ofTCEQ 217 regulation review. <br />j) Construction administratIon services In excess of a 9 month construction period. <br />k) Engineering and technical servIces that are required to investigate differing <br />subsurface or physical condItions. <br />1) DeVIations from the anticipated schedule or duration of construction that <br />materially affects the scope of the Engineer's SDC. <br />m) Supplemental classroom Instructions to the City's staff covering both the basic <br />operational concept and actual operation of the systems and components under <br />both normal and abnormal operations that are likely to occur, if requested. <br />n) Assistance to the CIty in startup and initial operatIon if requested which might <br />Include preparing a Plan of Operation to identIfy specific actions and related <br />completion dates for startup and operation of the new facilities and assisting the <br />City during the initial start-up of the new facilities. <br />0) Investigation and remedIation of possible hazardous materials encountered. <br /> <br />1.8.2 Each material change (deletion or addition) in the services to be provided by Engineer <br />must be authorized by the City on the Authorization of Change In Services form attached to this <br />Agreement as Attachment A. Compensation for addItional servIces will be in addition to that <br />specified for Basic Services in accordance with Section 15.2 of this Agreement.
