City Council Meeting Minutes November 5, 2014 <br />use they will not be requesting an alternate zoning. <br />Rob Roark, addressed the council regarding the construction on Hunter Rd across the street <br />from him with a developer filling land with materials from the Hunter Rd. Project with expired <br />permits. The City Staff went out and placed a stop work order and that lasted for one week. The <br />piles of dirt are now placing 9 -10 trees at risk because of the 4 -5 ft. piles of dirt against them. <br />Staff sited the developer again and placed another stop work order. <br />Gena Fleming, addressed the Council to afford the public to have more discussion on the <br />Habitat Conservation Plan and her main concern is the extermination of elephant ears and the <br />herbicide that is used to exterminate them. She stated that it is a violation of federal law to use <br />the type of herbicide because it is toxic to fresh water fish. She stated that the contract was <br />held and work was stopped, but then the contract was started again. She stated that this is not <br />the method that was approved by the HCP. <br />CONSENT AGENDA <br />A motion was made by Council Member Scott, seconded by Council Member Prather, that the <br />consent agenda be approved with the exception of Item #7 which was pulled to be considered <br />separately. The motion carried by the following vote: <br />For: 6 - Mayor Guerrero, Mayor Pro -Tem Thomaides, Deputy Mayor Pro Tern Becak, <br />Council Member Scott, Council Member Prather and Council Member Prewitt <br />Against: 0 <br />Absent: 1 - Council Member Thomason <br />5. Consider approval of the October 21, 2014, Regular Meeting Minutes <br />6. Consider approval of Ordinance 2014 -62, on the second of two readings, setting the <br />rate for Wholesale Water Treatment at the City's Surface Water Treatment Plant at <br />$0.4020 per thousand gallons; and including procedural provisions. <br />7. Consider approval of Ordinance 2014 -63, on the second of two readings, approving a <br />request by ETR Development Consulting, LLC for an amendment to the Preferred <br />Scenario Map of the City's Comprehensive Plan to change the Land Use Designation <br />for a six acre, more or less, tract of land out of the J .M. Veramendi Survey No.1, <br />located at the intersection of IH -35 and Luciano Flores Boulevard (Thornton); and <br />including procedural provisions. <br />A motion was made by Mayor Pro -Tem Thomaides, seconded by Council Member Scott, that this <br />Ordinance be amended to change the designation of the 3.7 acres from High Intensity to <br />Employment Center. The motion carried by the following vote: <br />For: 5 - Mayor Guerrero, Mayor Pro -Tem Thomaides, Deputy Mayor Pro Tern Becak, <br />Council Member Scott and Council Member Prewitt <br />Against: 0 <br />Absent: 2 - Council Member Thomason and Council Member Prather <br />A motion was made by Council Member Scott, seconded by Deputy Mayor Pro Tern Becak, that <br />this Ordinance be approved as amended.
