<br />53 <br /> <br />Regular Meeting <br /> <br />April 25, 1988 <br /> <br />Page 2 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING THE SAN MARCOS CODE OF ORDIN- <br />ANCES BY THE ADDITION OF CHAPTER 37, SEXUALLY ORIENTED <br />BUSINESSES, SETTING OUT PURPOSE AND INTENT, DEFINING <br />TERMS, CLASSIFYING SEXUALLY ORIENTED BUSINESSES, PRO- <br />VIDING FOR INSPECTIONS, PROVIDING A LICENSING SCHEME, <br />REGULATING THE LOCATION OF SEXUALLY ORIENTED BUISNESSES, <br />PROVIDING ADDITIONAL REGULATIONS FOR VARIOUS CLASSIFI- <br />CATIONS OF SEXUALLY ORIENTED BUSINESSES, PROVIDING FOR <br />ENFORCEMENT, AND REQUIRING SIGNS; AMENDING APPENDIX A, <br />GENERAL ZONING ORDINANCE OF THE SAN MARCOS CODE OF <br />ORDINANCES, BY ADDING SEXUALLY ORIENTED BUSINESSES AS <br />A SPECIFIC USE IN COMMERCIAL DISTRICTS; AND ESTABLISHING <br />AN EFFECTIVE DATE. <br /> <br />Mayor Younger opened the public hearing and asked if anyone wished to <br />speak regarding the Ordinance. Bob Anderson stated he felt the Ordin- <br />ance recommended by the Zoning Commission would help. He stated rape <br />in San Marcos in 1987 was up 173%. Ollie Giles stated she was a con- <br />cerned citizen and a Christian and did not want this type business in <br />our town and hopes the Ordinance will help. Frank Arredondo stated he <br />wants the Ordinance passed and enforced and does not want these busi- <br />nesses in our community. Jim Humphries stated he appreciates the Coun- <br />cil's reception to the citizen's feelings and hopes there will not be <br />a need to come before the Council on issues of sin in the future. He <br />stated if the citizens will let their convictions be known, we will not <br />have these type businesses in our C~ty. John Meeks stated he wants <br />funds spent to uphold this Ordinance when it is adopted. He stated <br />two years ago he objected to two massage parlors be allowed to oper- <br />ate. He stated when public opinion causes an Ordinance to be adopted, <br />he hopes the Ordinance will deter businesses of this nature from coming <br />here. Bill Bradford stated he had read the Ordinance and was concerned <br />the businesses could locate 1000 feet from residences, churches and <br />schools and would like the Ordinance strengthened by the increase of <br />the distance. He wants the Ordinance to state who these businesses <br />are by having them clearly identified. He is in favor of the businesses <br />needing to go before the Zoning Commission and expressed that he was <br />opposed to these type businesses and is in favor of the Ordinance. <br />Jack Major stated he thinks the fee to operate this type business <br />should be substantial and should be increased to a minimum of $1000. <br />John Gumonek (sp?) stated any form of a sexually oriented business would <br />be a shame and stated such businesses should not be allowed to operate <br />in areas of residences. Tony Romans stated he did not want these type <br />businesses allowed to operate in San Marcos at all and stated the dis- <br />tance of 1000 feet is closer than he would want. David Standefer stated <br />he teaches grades 7-12 and that such items are found the children's <br />lockers. He was concerned about the amendment offered which changes <br />compliance time from 10 days to 30 days. Matt Wohlfarth stated he is <br />a student at SWT and has no wife or children but is concerned with <br />pornography and feels it is harmful to society. Tim Clemens is in <br />favor of the City defending a strict Ordinance and wants the Council <br />to stand up against S.O.B.s He feels the Ordinance has been watered <br />down. Dave Glover stated he would like S.O.B.s to be done away with <br />and feels allowing them to exist in our City is a deterrent from at- <br />tracting people to our City. He wants the Ordinance to be as strong <br />as the City can make it. Frank Thornton stated there are Federal and <br />State laws against S.O.B.s that can be enforced through the District <br />Attorney and the District Attorney needs to be encouraged to enforce <br />them. Michael Delgado stated he is against having S.O.B.s in our com- <br />munity and stated not much distance is required. He thinks this Ordin- <br />ance will attract businesses rather than implement the Penal Code. Mr. <br />
