<br />approval by the City Council. With respect to the Economic Development Director <br />the City Council shall have final authority over all employment decisions. <br />3. The Chamber agrees that the Economic Development Director will provide reports <br />directly to the ED Board and the City Council, and will cooperate fully with the ED <br />Board, the City Council and the City staff in all matters related to economic <br />development. <br />G. Program of Services; Performance Measures; Performance Review Plans; <br />Budget. <br />1. The Chamber will, in consultation with the Economic Development Director and the <br />ED Board, develop and submit to the City Council the following, no later than <br />November 30, 2007, covering the first year of this Agreement, for review and <br />approval by the City Council: <br />a. A proposed program of economic development services; <br />b. Proposed performance measures; and, <br />c. A proposed performance review plan. <br />2. For the second year and anyone-year extension period for this Agreement after the <br />first year, the Chamber will, in consultation with the Economic Development <br />Director and the ED Board, develop and submit the following to the City no later <br />than the July 315t that precedes the extension period, covering the extension period, <br />for review and approval by the City Council: <br />a. A proposed program of economic development services; <br />b. Proposed performance measures; and <br />c. A proposed performance review plan; and, <br />d. A proposed budget for the fiscal year. <br />3. At a minimum, the performance review plan will include a written quarterly report <br />concerning issues related to economic development in the area of the City. The <br />Economic Development Director will present this report to the City Council in <br />executive session to the extent needed to protect the confidentiality of information <br />from business prospects while assuring compliance with the Texas Open Meetings <br />Act. The report will describe the Chamber's economic development activities in the <br />preceding quarter and will include, but not be limited to the following items: <br /> <br />Page 3 of8 <br />
