Mr. Gonzalez stated the Bugg Lane area will be uncontrollable, and the City will need to respond, and there will be possible overtime to accomplish this. Since the City is involved in this event, the City will need to address and pay for the overtime if it is needed, which will be an additional demand on the Police Department. Mayor Morris wants the City's police off-duty fee reviewed to make them competitive, and Mr. Gonzalez stated they compete for off-duty assignments with Smith Security and the Hays County Sheriff's Department. Mr. Gonzalez stated when other agencies are hired, the San Marcos Police Department is still sometimes involved in getting them out of situations. Staff is to bring to the Council recommendations for off-duty pay for the Police Department. Mr. Hernandez moved the Council adjourn into Executive Session pur- suant to Article 6252-l7, §§2(e) and (g), V.A.C.S., to discuss matters where the duties of the City Attorney to the City pursuant to the Code of Professional Responsibility of the State Bar of Texas clearly conflicts with Article 6252-17; duties of a public officer or employee, respectively, and Mayor Morris seconded the motion, which passed unanimously (10:25 p.m.). Mr. Moore moved the Council reconvene at 11:30 p.m. and Ms. Kissler seconded the motion, which passed unanimously.
