Regular Meeting November 20, 2007 <br />Page 7 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING AN AGREEMENT BETWEEN THE CITY AND THE CITY OF KYLE ACCEPTING <br />A RELEASE BY KYLE OF .865 ACRES MORE OR LESS OF EXTRATERRITORIAL <br />JURSIDICTION AT YARRINGTON AND POST ROADS FOR THE CONSTRUCTION OF THE <br />YARRINGTON ROAD RAILROAD OVERPASS; AUTHORIZING THE MAYOR TO EXECUTE <br />THE AGREEMENT ON BEHALF OF THE CITY, AND CONTAINING PROCEDURAL <br />PROVISIONS. <br />Mr. Bose moved for approval of Ordinance on first reading, Mr. Guerrero <br />seconded the motion. Ms. Anderson stated in reviewing the Yarrington Road <br />Overpass TIRZ agreement Staff discovered a small portion of land was in the <br />Kyle ETJ. She stated Staff held discussions with Kyle and on September 18, <br />2007 the Kyle City Council voted to release the subject property from their <br />jurisdiction. She stated Staff has begun the annexation process for this <br />tract, but the City of Kyle has stipulated that San Marcos must officially <br />act to accept this 1.855 acre tract into our ETJ. She stated the adoption <br />of this Ordinance acknowledges this transfer and allows annexation to <br />proceed. The Council then voted unanimously for approval of Ordinance on <br />first reading. <br />Mayor Narvaiz introduced a discussion and receive an update on the efforts <br />of the (SARA) Scanning Analysis Response Assessment Model and direction to <br />Staff. Howard Williams, Chief of Police, provided Council with a Memorandum <br />regarding an update on SARA Problems Solving Model. He explained the <br />attached Memorandum. Ms. Jamison stated the demographics with the hills <br />have an affect on the situation as well. Mr. Thomaides inquired to the <br />University only enforcing State laws. Ms. Jamison stated the Legal <br />Department has recently began working on an agreement with the University <br />regarding the enforcement of City Ordinances. Mr. Thomaides inquired to the <br />creation of an Alcohol Task Force. Chief Williams stated Staff is still in <br />the discussion stage and working through options. He stated he feels the <br />Alcohol Task Force will not work as a short term answer, but Staff is still <br />considering as a long term plan. Mr. Thomaides inquired to the current <br />nuisance abatement Ordinance, the only part that can be enforced is the <br />noise portion. He inquired to the portion of the Ordinance which provides <br />for junk cars. Chief Williams stated this Ordinance allows for removal and <br />citations, but we cannot go against the property owner. He stated the <br />Police can only move against the property owner for noise issues and not <br />against them for the condition of the property. Mayor Narvaiz stated the <br />report the Council received from Lisa Dvorak went through all the steps and <br />stages. She stated one thing was the multi - agency task force, which could <br />be brought back for consideration. She stated Council has been asking for <br />anything that could step up enforcement, an agreement with University Police <br />Department or stronger Ordinances, while Staff is going through the SARA <br />model. Chief Williams stated he can bring a successful Ordinance to the <br />Council once the research is complete. He stated he wants to make sure this <br />is done correct and feels Council should not rush. Mayor Narvaiz stated <br />the Council was provided an Ordinance that provided a provision that allowed <br />
