City Council Meeting Minutes January 6, 2015 <br />8. Consider approval of Resolution 2015 -02R awarding an Indefinite Delivery, Indefinite <br />Quantity (IDIQ) Master Contract for Traffic Signal Construction and Maintenance to <br />Austin Traffic Signal Construction Company, Inc. in the estimated annual amount of <br />$534,470.00 contingent upon the bidder's timely submission of sufficient bonds and <br />insurance in accordance with the City's bid documents for the project; authorizing the <br />City Manager or his designee to execute the contract documents on behalf of the City; <br />and declaring an effective date. <br />9. Consider approval of Resolution 2015 -03R approving the annual renewal of the <br />Microsoft Enterprise Agreement with SHI Government Solutions for software licenses <br />in accordance with the State of Texas Department of Information Resources Contract <br />#DIR -SDD -2503 in the annual amount of $204,578.00; authorizing the City Manager <br />or his designee to execute the appropriate documents related to the renewal of this <br />agreement; and declaring an effective date. <br />PUBLIC HEARINGS - 7:00 PM <br />10. 7:OOPM Receive a Staff presentation and hold a Public Hearing to receive comments <br />for or against Ordinance 2015 -01 amending Chapter 74 of the San Marcos City Code <br />by adding a new Article 6 that establishes procedures and criteria for the granting of <br />revocable licenses for Sidewalk Cafes, Parklets, and similar special uses of Public <br />Rights -Of -Way; providing a savings clause; providing for the repeal of any conflicting <br />provisions; and consider approval of Ordinance 2105 -01, on the first of two readings. <br />Andrea Villalobos, Planner, provided a brief presentation. <br />Mayor Guerrero opened the Public Hearing at 7:14 p.m. <br />Carina Boston Pinales, 612 W. Hopkins, spoke in favor of the parklets and spoke of the positive <br />experiences that she has had with them in various communities. <br />Don Eyssen, 200 Orchard, really good on paper, but wondered how many people are really going <br />to be enjoying these when it's 100 degrees outside most of the time. We don't have the building <br />setbacks and you would be taking away parking. <br />A motion was made by Deputy Mayor Pro Tern Scott, seconded by Mayor Pro -Tem Prather, to <br />approve Ordinance 2015 -01, on the first of two readings, <br />A motion was made by Deputy Mayor Pro Tern Scott, seconded by Council Member Hughson, <br />that Ordinance 2015 -01 be amended by prohibiting smoking in sidewalk cafes. The motion <br />carried by the following vote: <br />For: 4 - Council Member Thomaides, Council Member Thomason, Deputy Mayor Pro Tern <br />Scott and Council Member Hughson <br />Against: 3 - Mayor Guerrero, Mayor Pro-Tern Prather and Council Member Prewitt <br />A motion was made by Council Member Hughson, seconded by Deputy Mayor Pro Tern Scott, <br />that Ordinance 2015 -01 be postponed until Staff felt it was ready to come back.
