City Council Meeting Minutes January 6, 2015 <br />Against: 6 - Mayor Guerrero, Council Member Thomaides, Council Member Thomason, <br />Deputy Mayor Pro Tern Scott, Mayor Pro -Tem Prather and Council Member <br />Prewitt <br />A motion was made by Council Member Hughson, seconded by Council Member Thomaides, <br />that Ordinance 2015 -01 Section 74.203 (a) be amended to strike the word "will" and replace it <br />with "may ". The motion carried by the following vote: <br />For: 7 - Mayor Guerrero, Council Member Thomaides, Council Member Thomason, <br />Deputy Mayor Pro Tern Scott, Mayor Pro -Tem Prather, Council Member Prewitt <br />and Council Member Hughson <br />Against: 0 <br />Mayor Guerrero then called for a vote on the motion by Deputy Mayor Pro Tern Scott, seconded <br />by Mayor Pro -Tem Prather, to approve Ordinance 2015 -01, on the first of two readings as <br />amended. <br />For: 6 - Mayor Guerrero, Council Member Thomaides, Council Member Thomason, <br />Deputy Mayor Pro Tern Scott, Mayor Pro -Tem Prather and Council Member <br />Prewitt <br />Against: 1 - Council Member Hughson <br />11. TOOPM Receive a Staff presentation and hold a Public Hearing to receive comments <br />for or against Resolution 2015 -04R approving a request by ETR Development <br />Consulting LLC, on behalf of Casey Development, Ltd, for an agreement that grants a <br />SmartCode Height Warrant allowing two additional stories to be added for <br />construction of a proposed building at 101 Concho Street between North LBJ Drive <br />and North Guadalupe Street; said Warrant being in addition to a Warrant previously <br />approved by the Planning and Zoning Commission for the construction of a 13 story <br />building at that location; authorizing the City Manager to execute said agreement on <br />behalf of the City; and consider approval of Resolution 2015 -04R. <br />Kristy Stark, Assistant Director of 'Development Services, provided the Council with a brief <br />presentation of the project and Planning and Zoning's recommendation. <br />Ed Theriot, ETR Development Consulting, provided the Council with a brief presentation of the <br />project. <br />Mayor Guerrero opened the Public Hearing at 8:19 p.m. <br />Melissa Derrick, 109 Kathryn Cove;, asked the Council to postpone due to the water table over in <br />that area. She questioned the `jelly fish' that was mentioned. She echoed Curtis Seebeck's <br />comments during the Planning and Zoning Commission's consideration. She stated that she felt <br />that we don't know if this is going to be rent by the bedroom or rent by the unit housing. <br />Jay Hebert, t 209 W. Sierra Circle, spoke against this project and how what started as a 3 story <br />building has increased to 13 all because it was not economically viable. He urged the Council to <br />vote against this. <br />Don Eyssen, 200 Orchard, stated that if we do approve it then to have a clause in there of 20 <br />years no sale. He stated that they already have a 30% reduction on parking so they are already <br />making their parking. He mentioned concerns with the 'jelly fish'.
