<br />3 <br /> <br />Special Meeting <br /> <br />February 2, 1987 <br /> <br />Page 3 <br /> <br />other Council Members before third reading regarding Exemptions per- <br />taining to Part E.l.02 regarding the MGD's authorization to issue bonds. <br />Mr. Eankins stated the Council has the right to limit the total bonded <br />indebtedness and what the MUD can bond for. Mayor Younger stated he <br />does not want to control the amount of bonds if it would keep the pro- <br />ject from getting off the ground and they are already controlled some- <br />what by the Water Commission. Council will consider whether or not <br />to delete from the City's MUD Creation Ordinance provisions as gutters, <br />inlets, curbs, culverts and bridges being bonded or not. Mr. hankins <br />stated the City's approval right is taken away the way Section 1.04 is <br />presently written. Mayor Younger wants Mr. Lewis to look at accept- <br />able wording for the City to be able to stop construction if the MUD <br />is doing anything badly. Council was in consensus of a stoppage for <br />thirty days and injunction procedure if the delay is to be more than <br />thirty days and to add the word "unecessarily" to Section 1.04. Mr. <br />hankins stated Section 1.04 affects every provision of the agreement. <br />It was consensus of both parties to delete Section 1.04 from the Agree- <br />ment in its entirety. Mr. Coddington stated he thinks the Water Commis- <br />sion has enough safeguards in place regarding Section 2.02, and Mr. <br />Hankins stated he wants there to be wording added for the City's ap- <br />proval. Mayor Younger and Mr. Coddington we~ in agreement with the word- <br />ing presented in Section 2.02 and Messrs. Farr and Nicola and Ms. Kissler <br />want our Ordinance to retain the approval process. The Council directed <br />suggested amendments be made to the City's MUD Ordinance and presented <br />at the next meeting for the Council to decide what amendments they want. <br />Mayor Younger wanted to know if the MUD would have unlimited assessment <br />authority in Section 2.04(b), and Mayor Younger was advised the Board <br />is elected from the people of the District. Mayor Younger expressed <br />concern in Section 3.01 regarding no disruption of service, and Ms. <br />Richardson advised Mayor Younger this is in regard to disruption of <br />right rather than service. The Council discussed water and wastewater <br />LUEs of approximately $5.7 million for the regional facilities and <br />$25 million total and Mr. Gonzalez advised the City would be getting <br />a lump sum "up front" with this agreement. Mr. Hankins stated in Sec- <br />tion 3.04 the debt will be assumed by all citizens if annexed before <br />the bond debt is retired. Mr. Gonzalez stated there is a problem with <br />the wording in Section 3.08(b). he wants the City to be more involved <br />in the selection of the project engineer and will work on proposed <br />language for the third reading of the Ordinance. Mr. Gonzalez stated <br />additioml language needs to be added to Section 3.11 regarding the <br />City charges. The City does not have coordination in Section 4.01. <br />Mr. Gonzalez read language for the Council's approval. Mr. Lewis <br />said they agree to operate and maintain and have open to the public <br />the parkland, and that they may designate other areas just for the <br />City. Mr. Hankins stated City park standards have not been addressed. <br />Mayor Younger stated he has no problem with Section 5.01, and Mr. <br />Hankins stated the City needs more flexibility in this Section. Mr. <br />Lewis agreed to a lower percentage figure, and Council agreed to 90%. <br />Mr. Lewis agreed to 95%. Mr. Hankins is not in agreement with the <br />language in Article 9 and wants language incorporated for occurrence <br />prior to issuance of bonds or be null and void. Article 10 needs to <br />provide the City will provide the services if it chooses to do so, or <br />they can get service elsewhere. In the third reading packet, the <br />January 21,1987 agreements will be provided to the Council with a <br />memorandum to state all amendments that need to be considered by the <br />Council formally.
