<br />72 <br /> <br />Regular Meeting <br /> <br />April 13, 1987 <br /> <br />Page 3 <br /> <br />Mayor Younger introduced for consideration a public hearing and <br />adoption of a Zoning Ordinance, the caption which was read as fol- <br />lows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE <br />WHICH REGULATES AND RESTRICTS THE LOCATION AND USE <br />OF BUILDINGS, STRUCTURES AND LAND, DATED JUNE 13, <br />1984 (VOL. 66) BY ZONING BLOCK 10, LOTS D AND E OF <br />SCHNEIDERS REARRANGEMEENT OF LOTS 51 and 52, BLOCK <br />10 OF THE WESTOVER ADDITION TO THE CITY OF SAN MAR- <br />COS AS RECORDED IN VOLUME 4, PAGE 275 OF THE HAYS <br />COUNTY PLAT RECORDS, LOCATED AT THE SOUTH CORNER <br />OF THE INTERSECTION OF CLYDE STREET AND BAYLOR STREET, <br />FROM "R-l" (SINGLE-FAMILY DWELLING DISTRICT [LOW DEN- <br />SITY]) TO "DP-211 (DUPLEX DISTRICT [MEDIUM DENSITY]) <br />AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mayor Younger opened the public hearing and asked if anyone wished <br />to speak in favor or in opposition to the Zoning change. Laura <br />Schneider of Comet Construction was present to answer questions of <br />the Council and advised the Council only Lot D needed to be rezoned. <br />Charles Schwart stated he owns four lots in the same block and that <br />he supports this zoning change. No one else wished to speak in favor <br />or in opposition, so Mayor Younger closed the public hearing. Mr. <br />Coddington moved for adoption of the Zoning Ordinance and Mr. Farr <br />seconded the motion. Mayor Younger moved to amend the Ordinance in <br />the caption, in the first paragraph beginning with the word "WHEREAS", <br />and in the legal description in SECTION 1 to delete Lot E and just to <br />rezone Block 10, Lot D and Mr. Brown seconded the motion, which passed <br />unanimously. The Council then voted unanimously for adoption of the <br />Zoning Ordinance. <br /> <br />Mayor Younger introduced for consideration a public hearing and adoption <br />of a Zoning Ordinance, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, ~lENDING SECTION 3 OF THAT ORDINANCE <br />WHICH REGULATES AND RESTRICTS THE LOCATION AND USE <br />OF BUILDINGS, STRUCTURES AND LAND, DATED JUNE 13, <br />1984 (VOL. 66) BY ZONING PREVIOUSLY UNZONED PROPERTY <br />TO A ZONING DESIGNATION OF IIPUDII (PLANNED UNIT DEVELOP- <br />MENT DISTRICT), SAME BEING 0.489 ACRES, MORE OR LESS, <br />OF LAND AREA IN THE J. M. VERAMENDI SURVEY NO.2, BEING <br />A PORTION OF THAT 0.50 ACRE TRACT CONVEYED BY SAN MAR- <br />COS INDUSTRIAL FOUNDATION TO C. C. HOLT, ET UX, BY <br />DEED DATED SEPTEMBER 21, 1978 AND RECORDED IN VOLUME <br />316, PAGE 380 OF THE HAYS COUNTY DEED RECORDS, SAID <br />0.50 ACRE TRACT BEING A PORTION OF THAT 6.80 ACRE <br />TRACT CONVEYED BY C. C. HOLT TO CHARLES ú. NASH, JR. <br />BY DEED DATED OCTOBER 15, 1984 AND RECORDED IN VOLUME <br />475, PAGE 580 OF THE HAYS COUNTY REAL PROPERTY RECORDS; <br />SAID TRACT BEING LOCATED ON THE WEST SIDE OF IH-35 <br />NORTH AND ADJACENT TO BUTLER MANUFACTURING COMPANY; <br />APPROVING THE GRANTING OF A PERMIT BY THE PLANNING <br />COMMISSION FOR A PLANNED UNIT DEVELOPMENT ON SAID <br />0.489 ACRE TRACT; APPROVING A PLANNED UNIT DEVELOPMENT <br />PLAN FOR SAID 0.489 ACRE TRACT; AND DECLARING AN EF- <br />FECTIVE DATE. <br />
