125 Regular Meeting July 13,1987 Page 10 Mr. Brown moved for adoption of the Ordinance on emergency and Ms. Kissler seconded the motion, which passed unanimously. Mayor Younger introduced for consideration approval of an Ordinance on first reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, ABANDONING AND VACATING A 1.2 ACRE EASEMENT AND BEING THAT EASEMENT WHICH ABUTS AND IS LOCATED IN LOTS 14,19 AND 23 OF THE RIVER RIDGE SUB- DIVISION OF 146.57 ACRES OF LAND, MORE OR LESS, IN THE J. M. VERAMENDI SURVEY NO.2, CITY OF SAN MARCOS, HAYS COUNTY, TEXAS; AUTHORIZING THE MAYOR OF SAID CITY TO EXECUTE SPECIAL WARRANTY DEEDS; REFLECTING FAIR EX- CHANGE OF PROPERTY; AND DECLARING AN EFFECTIVE DATE. Mr. Farr moved for approval of the Ordinance on first reading and Ms. Kissler seconded the motion. During discussion Mayor Younger and Mr. Guerra expressed concern for the Hernandez family and Tim Dorsett access problems and the Council requested this be resolved as soon as possible. Mr. Robbins advised the Council this abandonment is not related to the other problem. On roll call the following vote was recorded: AYE: Brown, Farr, NAY: Guerra. ABSTAIN: None. Younger, Hernandez, Kissler, Nicola. Mayor Younger introduced for consideration approval of an Ordinance on first reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, AMENDING SECTION 5-81 OF CHAPTER 5, BUILDING AND BUILDING REGULATIONS, OF THE SAN MARCOS CODE OF ORDINANCES TO PROVIDE THAT APPEALS UNDER THE STANDARD UNSAFE BUILDING ABATEMENT CODE ARE TO THE BUILDING BOARD OF ADJUSTMENTS AND DECLARING AN EFFECTIVE DATE. Mayor Younger introduced for consideration approval of an Ordinance on first reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, REPEALING SECTIONS 16-22 THROUGH 16-34 OF THE SAN MARCOS CODE OF ORDINANCES AND ADOPTING IN ITS PLACE NEW SECTIONS 16-22 THROUGH 16-32, PROVID- ING PROCEDURES FOR THE IMPOUNDMENT AND SALE OF PERSONAL PROPERTY DECLARED A NUISANCE, ESTABLISHING FEES FOR THE IMPOUNDMENT OF PERSONAL PROPERTY, AND ESTABLISH- ING AN EFFECTIVE DATE. Mr. Farr moved for approval of the Ordinance on first reading and Ms. Kissler seconded the motion. Mayor Younger moved to amend the Ordinance in Sec. 16-26. (b) After sale. by amending " . . . double the amount paid by him [Buyer] for the property. . ." to ". . . one and one-third the amount. . .", and Mr. Hernandez seconded the motion.
