<br />10 <br /> <br />Regular Meeting <br /> <br />September 14, 1987 <br /> <br />Page 3 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING CHAPTER 35, COMPREHENSIVE <br />DEVELOPMENT CODE OF THE SAN MARCOS CODE OF ORDIN- <br />ANCES BY PROVIDING FOR VARIANCES AND APPEALS, CLARI- <br />FYING BUFFERYARD REQUIREMENTS, ESTABLISHING THE <br />NUMBER OF REQUIRED DEED RESTRICTION COPIES, ESTABLISHING <br />A RECORDING FEE, CLARIFYING THE PDD PROCESS, ADDING <br />APPENDIX C, PLAN REQUIREMENTS, CLARIFYING THE DISCRE- <br />TIONARY BONUS AWARD PROCESS, ESTABLISHING BASE DENSITY, <br />AND ESTABLISHING AN EFFECTIVE DATE. <br /> <br />Mayor Younger opened the public hearing and asked if anyone wished <br />to speak in favor or in opposition to the amendment. No one did, <br />so Mayor Younger closed the public hearing. Mr. Nicola moved to <br />approve the Ordinance on first reading and Mr. Guerra seconded the <br />motion. Mayor Younger asked if the bufferyard provisions could be <br />changed, and Mr. Robbins stated thE~ Ordinance would have to be amend- <br />ed, and Mr. Hankins stated the City would have to go through a process <br />to amend the deed restrictions to make changes. Mayor Younger asked <br />about the requirement that a PDD be wholly inside or outside the City <br />limits. Mr. Robbins stated it caused administrative difficulties if <br />the PDD was not either wholly in or out of the City, and that if the <br />City is to provide water and sewer services, it would be best to an- <br />next the property; and if the property is not contiguous to the City, <br />that the PDD be wholly outside the City. On roll call the following <br />vote was recorded: <br /> <br />AYE: <br /> <br />Brown, Farr, Guerra, Hernandez, Kissler, Nicola. <br /> <br />NAY: <br /> <br />Younger. <br /> <br />ABSTAIN: <br /> <br />None. <br /> <br />Mayor Younger introduced for consideration a public hearing and approv- <br />al of an Ordinance on first reading, the caption which was read as fol- <br />lows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS AMENDING CHAPTER 36, SAN MARCOS RIVER <br />CORRIDOR, OF THE SAN MARCOS CODE OF ORDINANCES BY <br />CORRECTING TYPOGRAPHICAL ERRORS, CLARIFYING REZONING <br />AND SITE PLAN REQUIREMENTS, INCREASING THE IMPERVIOUS <br />COVER SETBACK, PROVIDING FOR REVIEW OF PLANS BY THE <br />DIRECTOR OF ENVIRONMENT AND ENGINEERING, INCLUDING <br />AUSTIN BASIN GUIDELINES, EXPANDING SAN MARCOS RIVER <br />CORRIDOR BOUNDARIES, CLARIFYING ENGINEERING REQUIRE- <br />MENTS, ESTABLISHING THE SITE PLAN SCALE AND DECLARING <br />AN EFFECTIVE DATE. <br /> <br />Mayor Younger opened the public hearing and asked if anyone wished <br />to speak to the amendment. Jay Moore referred to Gary McCoig's memo- <br />randum dated October 23, 1986 to the Planning and Zoning Commission <br />increasing the setback requirements to 100 feet and expanding the <br />boundaries of the Ordinance to 2000 feet up the river's tributaries. <br />He stated he does not think all this applies to the San Marcos River. <br />He stated he would like to see the criteria remain the same as is in <br />existence now for open areas where there is dense vegetation. Mr. <br />Farr asked Staff for more information at second and third readings <br />regarding the 35% slopes. Mr. Moore asked what warranted the changes <br />requested in Mr. McCoig's memorandum regarding the increasing to 2,000 <br />feet up tributaries and Mr. Robbins stated the Ordinance is to be re- <br />viewed annually, and the documentation supported the need for the in- <br />crease. No one else wished to speak in favor or in opposition, so <br />Mayor Younger closed the public hearing. Mr. Brown moved to approve <br />
