67 Regular Meeting October 12, 1987 Page 3 Mayor Younger returned to Item SA on the Agenda, and introduced for consideration a public hearing and approval of an Ordinance on first reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING APPENDIX A, GENERAL ZONING ORDINANCE, OF THE SAN MARCOS CODE OF ORDINANCES BY EXPANDING THE PURPOSE PROVISIONS OF THE ORDINANCE, CLARIFYING THE METHOD OF CALCULATING THE AREA OF PROTEST FOR ZONING CHANGES, REVISING PROVISIONS FOR DURATION AND RENEWAL OF SPECIFIC USE PERMITS, CLARI- FYING THE DESCRIPTION OF SIGHT-TRIANGLE, ADDING NEW OFF-STREET PARKING REQUIREMENTS, DELETING CURB CUT REQUIREMENTS, AND ESTABLISHING AN EFFECTIVE DATE. Mayor Youn~r:opened the public hearing and asked if anyone wished to speak for or against the amendment. S. Hanes, a student from Southwest Texas State University, asked what the purpose of the Ordinance is, and Mayor Younger replied the amendment deals with street cuts and provides further clarification of the Ordinance. No one else wished to speak for or against the Ordinance, so Mayor Younger closed the public hear- ing. Mr. Farr moved to approve the Ordinance on first reading and Ms. Kissler seconded the motion. On roll call the following vote was re- corded: AYE: Brown, Farr, NAY: Younger. ABSTAIN: None. Guerra, Hernandez, Kissler, Nicola. Mayor Younger introduced for consideration a public hearing and approval of an Ordinance on first reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE SAN MARCOS CODE OF ORDIN- ANCES BY THE ADDITION OF CHAPTER 5, ARTICLE V, ENTITLED "PUBLIC RIGHT-OF-~vAY ACCESS ORDINANCE ", REGULATING THE SITING, DESIGN AND CONSTRUCTION OF DRIVEWAYS WHICH AC- CESS PUBLIC STREETS, BY DEFINING TERMS; REQUIRING CON- STRUCTION PERMITS; AUTHORIZING THE CITY ENGINEER TO DETERMINE THE EFFECTS OF CONSTRUCTION UPON THE RIGHT OF THE PUBLIC TO FREE AND UNHAMPERED PASSAGE OVER PUBLIC STREETS AND SIDEWALKS AND UPON THE PUBLIC SAFETY, TO DETERMINE THE ADEQUACY OF CONSTRUCTION MATERIALS, AND TO PROMULGATE DESIGN STANDARDS; SETTING REQUIREMENTS FOR CONTRACTORS; ESTABLISHING PERMIT FEES AND TERMS; EXEMPTING CERTAIN CONSTRUCTION FROM COMPLIANCE; PROVID- ING PENALTIES; PROVIDING FOR APPEALS; PROVIDING FOR SEPARABILITY; AND DECLARING AN EFFECTIVE DATE. Mayor Younger opened the public hearing and asked if anyone wished to speak for or against the Ordinance. No one did, so Mayor Younger closed the public hearing. Mr. Guerra moved for approval of the Ordin- ance on first reading and Ms. Kissler seconded the motion. Mr. Robbins advised a fee will be paid if access is sought other than through the platting or building process. Mayor Younger pointed out a typographical error on Page 3 (Sec. 5-200.f.(22) to change "(22)" to "(21)". The Council voted unanimously for approval of the Ordinance on first reading.
