<br />67 <br /> <br />Regular Meeting <br /> <br />October 12, 1987 <br /> <br />Page 3 <br /> <br />Mayor Younger returned to Item SA on the Agenda, and introduced <br />for consideration a public hearing and approval of an Ordinance <br />on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING APPENDIX A, GENERAL ZONING <br />ORDINANCE, OF THE SAN MARCOS CODE OF ORDINANCES BY <br />EXPANDING THE PURPOSE PROVISIONS OF THE ORDINANCE, <br />CLARIFYING THE METHOD OF CALCULATING THE AREA OF <br />PROTEST FOR ZONING CHANGES, REVISING PROVISIONS FOR <br />DURATION AND RENEWAL OF SPECIFIC USE PERMITS, CLARI- <br />FYING THE DESCRIPTION OF SIGHT-TRIANGLE, ADDING <br />NEW OFF-STREET PARKING REQUIREMENTS, DELETING CURB <br />CUT REQUIREMENTS, AND ESTABLISHING AN EFFECTIVE <br />DATE. <br /> <br />Mayor Youn~r:opened the public hearing and asked if anyone wished to <br />speak for or against the amendment. S. Hanes, a student from Southwest <br />Texas State University, asked what the purpose of the Ordinance is, and <br />Mayor Younger replied the amendment deals with street cuts and provides <br />further clarification of the Ordinance. No one else wished to speak <br />for or against the Ordinance, so Mayor Younger closed the public hear- <br />ing. Mr. Farr moved to approve the Ordinance on first reading and Ms. <br />Kissler seconded the motion. On roll call the following vote was re- <br />corded: <br /> <br />AYE: Brown, Farr, <br />NAY: Younger. <br />ABSTAIN: None. <br /> <br />Guerra, Hernandez, Kissler, Nicola. <br /> <br />Mayor Younger introduced for consideration a public hearing and approval <br />of an Ordinance on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING THE SAN MARCOS CODE OF ORDIN- <br />ANCES BY THE ADDITION OF CHAPTER 5, ARTICLE V, ENTITLED <br />"PUBLIC RIGHT-OF-~vAY ACCESS ORDINANCE ", REGULATING THE <br />SITING, DESIGN AND CONSTRUCTION OF DRIVEWAYS WHICH AC- <br />CESS PUBLIC STREETS, BY DEFINING TERMS; REQUIRING CON- <br />STRUCTION PERMITS; AUTHORIZING THE CITY ENGINEER TO <br />DETERMINE THE EFFECTS OF CONSTRUCTION UPON THE RIGHT <br />OF THE PUBLIC TO FREE AND UNHAMPERED PASSAGE OVER <br />PUBLIC STREETS AND SIDEWALKS AND UPON THE PUBLIC SAFETY, <br />TO DETERMINE THE ADEQUACY OF CONSTRUCTION MATERIALS, <br />AND TO PROMULGATE DESIGN STANDARDS; SETTING REQUIREMENTS <br />FOR CONTRACTORS; ESTABLISHING PERMIT FEES AND TERMS; <br />EXEMPTING CERTAIN CONSTRUCTION FROM COMPLIANCE; PROVID- <br />ING PENALTIES; PROVIDING FOR APPEALS; PROVIDING FOR <br />SEPARABILITY; AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mayor Younger opened the public hearing and asked if anyone wished <br />to speak for or against the Ordinance. No one did, so Mayor Younger <br />closed the public hearing. Mr. Guerra moved for approval of the Ordin- <br />ance on first reading and Ms. Kissler seconded the motion. Mr. Robbins <br />advised a fee will be paid if access is sought other than through the <br />platting or building process. Mayor Younger pointed out a typographical <br />error on Page 3 (Sec. 5-200.f.(22) to change "(22)" to "(21)". The <br />Council voted unanimously for approval of the Ordinance on first <br />reading. <br />
