68 Regular Meeting October 12, 1987 Fage 4 Mayor Younger introduced for consideration a public hearing and approval of an Ordinance on first reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE CODE OF ORDINANCES OF SAID CITY TO INCLUDE AN APPENDIX I, TO BE ENTITLED "PUBLIC RIGHT-OF-WAY CONSTRUCTION ORDINANCE", REGULATING THE SITING, DESIGN AND CONSTRUCTION WITHIN THE PUBLIC RIGHT-OF-WAY BY DEFINING TERMS; REQUIRING PERMITS FOR CONSTRUCTION; SETTING REQUIREMENTS FOR CONTRACTORS PERFORMING CONSTRUCTION; ESTABLISHING PERMIT FEES; PROVIDING A PERMIT TERM; EXEMPTING CERTAIN CONSTRUCTION FROM COMPLIANCE; PROVIDING PENALTIES; PEOVIDING FOR AP- PEALS; PROVIDING FOR SEPARABILITY; AND DECLARING AN EF- FECTIVE DATE. Mayor Younger opened the public hearing and asked if anyone wished to speak for or against the Ordinance. No one did, so Mayor Younger closed the public hearing. Ms. Kissler moved for approval of the Ordinance on first reading and Mr. Brown seconded the motion. Mayor Younger asked if we should define barricades and warning lights and their standards. George Boeker advised they will meet state stand- ards. Mayor Younger asked if we should define right-of-way, such as blocking sidewalks, and Mr. Boeker stated sidewalks are in the public right-of-way. Frank Robbins advised sidewalks are addressed in another Ordinance. The Council voted unanimously for approval of the Ordinance on first reading (Mr. Guerra not present to vote on this item). Mayor Younger introduced for consideration a public hearing and ap- proval of an Ordinance on second reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS AMENDING THAT ORDINANCE ADOPTED AUGUST 31,1987 WHICH SET FORTH AN ITEMIZED ESTIMATE OF THE EXPENSE OF CONDUCTING EACH ADMINISTRATIVE UNIT OF THE MUNICIPAL GOVERNMENT OF SAID CITY FOR THE FISCAL YEAR BEGINNING OCTOBER 1,1987 AND ENDING ON SEPTEMBER 30, 1987, AND APPROPRIATED MONEY FOR THE VARIOUS FUNDS AND PURPOSES OF SUCH ESTIMATE, TO REVISE SAID ESTIMATES AND TO REAPPROPRIATE SAID FUNDS, ADOPTING SAID REVI- SIONS AND ESTIMATES, AND DECLARING AN EFFECTIVE DATE. Mayor Younger opened the public hearing and asked if anyone wished to speak for or against the amendment. No one did, so Mayor Younger closed the public hearing. Mr. Farr moved for approval of the Ordin- ance on second reading and Ms. Kissler seconded the motion, which passed unanimously (Mr. Guerra not present to vote on this item). Mayor Younger introduced for consideration approval of an Ordinance on first reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN ~ffiRCOS, AMENDING CHAPTER 33 OF THE SAN ~ffiRCOS CODE OF ORDINANCES BY RENUMBERING EXISTING SECTION 33-11, BY ADDING A NEW SECTION 33-11, REMOVAL FROM THE ROTA- TION SYSTEM, AND ESTABLISHING AN EFFECTIVE DATE.
