City Council Meeting Minutes June 2, 2015 12. Consider approval, by motion, authorizing Change in Services No. 1 to Green Guy Recycling Services Drop Off Center and City Facilities Contract. PUBLIC HEARINGS - 7:00 PM 13. Consider approval of Ordinance 2015 -20, on the first of two readings, amending the San Marcos Smartcode by amending Section 1.5.2 and corresponding provisions to set a limit of seven stories as the maximum building height allowed by warrant, correcting Table 1.2 to reflect a building height limit of two stories in a T3 Transect, and amending Table 1.2 to reduce the building height limit from five stories to three stories in a T4 Transect; providing a savings clause; providing for the repeal of any conflicting provisions; and providing an effective date. Shannon Mattingly provided the Council with a brief presentation Mayor Guerrero opened the Public Hearing at 10:21 p.m. Tom Wassenich, 11 Tanglewood, asked the Council to support the proposed amendments to the SmartCode. There being no further comments, Mayor Guerrero closed the Public Hearing at 10:21 p.m. A motion was made by Council Member Thomaides, seconded by Council Member Prewitt, to approve Ordinance 2015 -20, on the first of two readings. The motion carried by the following vote: For: 5 - Mayor Guerrero, Council Member Thomaides, Council Member Thomason, Council Member Prewitt and Council Member Hughson Against: 2 - Deputy Mayor Pro Tern Scott and Mayor Pro -Tem Prather NON - CONSENT AGENDA 14. Consider approval of Ordinance 2015 -21, on the first of two readings, revising and updating Chapter 14, Buildings and Building Regulations, of the City Code; including procedural provisions; and providing for penalties. A motion was made by Council Member Thomason, seconded by Deputy Mayor Pro Tern Scott, that this Ordinance be postponed until June 16, 2015. The motion carried by the following vote: For: 7 - Mayor Guerrero, Council Member Thomaides, Council Member Thomason, Deputy Mayor Pro Tern Scott, Mayor Pro -Tem Prather, Council Member Prewitt and Council Member Hughson Against 15. Consider approval of Resolution 2015 -64R, approving an Economic Development Incentive Agreement with San Marcos 123 and 35 Partners Two, L.L.C., that waives certain sign standards under the City's Land Development Code in order to allow a freestanding pole sign within the San Marcos River corridor in connection with a proposed commercial development at Luciano Flores Boulevard and IH -35 North; and declaring an effective date.
