132 <br /> <br />Regular Meeting <br /> <br />July 27, 1981 <br /> <br />Page 4 <br /> <br />Mr. James introduced for consideration the. adoption of a Resolution <br />approving an Agreement with Texas Museum of History, Inc. pertaining <br />to the removal of a structure from Southwest Texas State University <br />property. Mrs. Norris moved to table this matter because the date <br />on the Contract of Sale between the City and Southwest Texas State <br />University is going to be changed from a date in September to a date <br />in December.and we have not received the Contract of Sale from the <br />University reflecting the new date. Mr. Brown .seconded the motion, <br />which passed unanimously. <br /> <br />Mr. James introduced for consideration the adoption of a Resolution <br />approving a Contract of Sale with Southwest Texas State University <br />for a structure on the university property. Mrs. Norris moved to <br />table this matter until we received the Contract of Sale from the <br />University with the changed date of removal and Mr. Kreczmer seconded <br />the motion, which passed unanimously. <br /> <br />Mr. James introduced for consideration approval of an Ordinance on <br />first reading amending Ordinance No. 1977-13 changing fees and grant- <br />ing a twenty-year Franchise Agreement to Lower Colorado RiVer Author- <br />ity. The Ordinance was read in its entirety, the caption which fol- <br />lows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING ORDINANCE NO. 1977- <br />13, ADOPTED MARCH 28, 1977, WHICH FIXED RENTAL <br />FEES TO BE PAID AND CONDITIONS AND REQUIREMENTS <br />TO BE MET BY THE LOWER COLORADO RIVER AUTHORITY <br />FOR THE PRIVILEGE OF CONTINUING TO ENTER UPON AND <br />USE THE STREETS, ALLEYS AND PUBLIC GROUNDS OF THE <br />CITY OF SAN MARCOS FOR THE PURPOSE OF DISTRIBUTING <br />ELECTRIC POWER AND ENERGY FOR LIGHTS, HEAT AND POWER <br />TO THE CITY AND ITS INHABITANTS TO INCREASE SAID <br />FEES TO FOUR PERCENT (4%) OF GROSS. RECEIPTS RE- <br />CEIVED BY THE LOWER COLORADO RIVER AUTHORITY; TO <br />GRANT A TWENTY (20) YEAR FRANCHISE TO THE LOWER <br />COLORADO RIVER AUTHORITY; SETTING A COLLECTION <br />PATTERN FOR SAID FEES AND DECLARING AN EFFECTIVE <br />DATE. <br /> <br />Mrs. Norris moved to approve the Ordinance on first reading and Mr. <br />Kreczmer seconded the motion, which passed unanimously. <br /> <br />Mr. James introduced for consideration authorization to use contingency <br />funds to cover flood damaged equipment and expenses. Attached to these <br />minutes is a memorandum from Mr. Earl Williams to Mr. A. C. Gonzalez <br />stating a breakdown of the amounts needed totalling $27,500.00 dated <br />July 19, 1981. Mrs. Norris moved that authorization be made for use <br />of contingency funds and Mr. Cavazos seconded the motion. On roll <br />call the following vote was recorded: <br /> <br />AYE: Brown, Cavazos, James, Mendez and Norris. <br /> <br />NAY: Kreczmer. <br /> <br />ABSTAIN: None. <br /> <br />Mr. James introduced for consideration approval to start annexation <br />proceedings of property known as Cape's Camp. Mr. Cavazos moved <br />that the annexation process be started and Mrs. Mendez seconded <br />the motion. On roll call the following vote was recorded: <br /> <br />AYE: Brown, Cavazos, James, Mendez and Norris. <br /> <br />NAY: Kreczmer. <br /> <br />ABSTAIN: None. <br /> <br /> <br />
