81 <br />Regular Meeting <br />November 9, 1981 <br />Page 5 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING CHAPTER 27, ENTITLED "TAXI- <br />CABS" OF THE CODE OF ORDINANCES, CITY OF SAN MARCOS, <br />TEXAS, TO DEFINE TERMS; TO REQUIRE A CERTIFICATE OF <br />PUBLIC CONVENIENCE AND NECESSITY FOR PERSONS WISHING <br />TO OPERATE A TAXICAB BUSINESS IN SAID CITY; TO SET <br />STANDARDS FOR THE ISSUANCE OF SAID CERTIFICATES; TO <br />SET FEES; TO PROVIDE STANDARDS FOR THE SUSPENSION <br />AND REVOCATION OF SAID CERTIFICATES; TO REQUIRE <br />TAXICAB DRIVERS' PERMITS; TO REQUIRE DISPLAY OF <br />SAID PERMIT; TO REQUIRE INSPECTION OF TAXICABS; TO <br />REQUIRE TAXIMETERS; TO REQUIRE FILING OF RATES OF <br />FARE AND THE DISPLAY OF RATE CARDS; TO SET STANDARDS <br />FOR THE PROVISION OF SAID SERVICE TO PASSENGERS; TO <br />REQUIRE THE KEEPING OF MANIFESTS; TO REQUIRE THE <br />KEEPING OF CERTAIN RECORDS AND REPORTS; TO DESIGNATE <br />AN ENFORCEMENT BODY; TO SET A PENALTY; TO PROVIDE FOR <br />SEPARABILITY; TO PROVIDE FOR REPEAL OF CONFLICTING <br />ORDINANCES AND DECLARING AN EMERGENCY. <br />Mrs. Norris moved that the Ordinance be adopted on emergency reading <br />in order to get the matter on the table for discussion and Mrs. Mendez <br />seconded the motion. Mayor Craddock asked if the persons interested <br />in starting a taxi service in San Marcos would like to address their <br />concerns and thoughts in regard to the Ordinance. Mr. Ralph Gonzales <br />wanted the city to set the fares. He didn't think San Marcos needed <br />taximeters. He felt the taxi companies should be required to have <br />fairly new model cars and wanted a provision in the Ordinance that <br />the owners of taxi companies should be residents of Hays County. <br />Mrs. Hannelore Brotze said there was not a rate in New Braunfels <br />established by the Council - that she charges 10 cents per 1/10th <br />mile plus 50 cents. She gives senior citizens a 10 percent discount. <br />She is opposed to the taximeters. Mr. Roger Jenkins thought there <br />should be a limitation set by the Council as to how many taxi com- <br />panies are allowed to operate in San Marcos. He thought this would <br />affect the quality of service provided by the taxi companies. <br />Mr. Brown moved that the Ordinance be tabled until the November 16, <br />1981 Council Meeting so that the provisions discussed by the persons <br />interested in starting taxi services and the Council could work out <br />the provisions of the new Ordinance and Mrs. Norris seconded the mo- <br />tion, which passed unanimously. <br />Mayor Craddock introduced for consideration an Ordinance on second <br />reading amending Chapter 11 entitled "Food and Food Establishments" <br />of the Code of Ordinances, the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING CHAPTER 11, ENTITLED "FOOD <br />AND FOOD ESTABLISHMENTS", OF THE CODE OF ORDINANCES <br />OF SAID CITY TO ESTABLISH A PURPOSE; TO DEFINE TERMS; <br />TO PROVIDE FOR THE SALE OF ONLY SOUND, PROPERLY LA- <br />BELED FOOD; TO REGULATE THE SOURCE OF FOOD; TO ESTAB- <br />LISH SANITATION STANDARDS FOR FOOD, FOOD PROTECTION, <br />FOOD SERVICE PERSONNEL, FOOD SERVICE OPERATIONS, FOOD <br />EQUIPMENT AND UTENSILS, SANITARY FACILITIES AND CON- <br />TROLS AND OTHER FACILITIES; TO REQUIRE PERMITS FOR <br />THE OPERATION OF FOOD SERVICE ESTABLISHMENTS; TO <br />REGULATE THE INSPECTION OF SUCH ESTABLISHMENTS; TO <br />PROVIDE FOR THE EXAMINATION AND CONDEMNATION OF FOOD; <br />TO PROVIDE FOR ENFORCEMENT AND TO SET PENALTIES AND <br />DECLARING AN EFFECTIVE DATE. <br />Mr. Kreczmer moved to approve the Ordinance on second reading and <br />Mr. James seconded the motion. Mr. Brown then moved that the Or- <br />dinance be amended in Section 11-11 (g)(3) to read that the Ordinance <br />would be in full force and effect as of January 1, 1982, and Mr. James <br />seconded the motion, which passed unanimously. The Council then con- <br />sidered approval of the Ordinance on second reading, which passed <br />unanimously.
