(1) The holder has violated any of the provisions <br />of this ordinance. <br />(2) The holder has discontinued operations for <br />more than ten (10) days. <br />(3) The holder has violated any ordinance of <br />the City of San Marcos, Texas, the laws of <br />the United States or the State of Texas, the <br />violation of which adversely affects the <br />ability of holder to offer public transportation. <br />Prior to suspension or revocation, the holder <br />shall be given notice of the proposed action, <br />the alleged causes therefor and shall have an <br />opportunity to be heard. <br />Sec. 27-10. Taxicab driver's permit. <br />No person shall operate a taxicab for hire upon the <br />streets of the City of San Marcos, and no person who <br />owns or controls a taxicab shall permit it to be so <br />driven, unless the driver of said taxicab shall have <br />in force a taxicab driver's permit issued under the <br />provisions of this ordinance. <br />Sec. 27-11. Application for taxicab driver's permit. <br />(1) The holder of a certificate of public conve- <br />nience and necessity shall file with the city <br />secretary an application for a taxicab driver's <br />permit for each driver employed by holder. On <br />said application the holder shall certify that <br />there is currently in effect an insurance policy <br />covering said driver while said driver is en- <br />gaged in the provision of taxi service. <br />(2) It shall be the responsibility of the holder <br />to immediately notify the city secretary should <br />said insurance required by (1) no longer be in <br />effect for a driver holding a permit and em- <br />ployed by holder. <br />Sec. 27-12. Issuance of taxicab driver's permit-duration <br />(1) Upon submission of the application for a taxicab <br />driver's permit, a permit shall be issued which <br />shall bear the name, address, signature and photo- <br />graph of the applicant. <br />(2) The permit shall be in effect for the remainder <br />of the calendar year. <br />Sec. 27-13. Display of permit. <br />Every driver operating pursuant to the terms of t"iis <br />ordinance shall post his/her taxicab driver's permit in <br />such a place as be in full view of all passengers whilo <br />such driver is operating a taxicab. <br />Sec. 27-14. Failure to comply with city, state and federal <br />laws. <br />Every driver receiving a permit under the terms of this <br />ordinance shall comply with all city, state and federal <br />laws. Failure to do so will justify the suspension or <br />revocation of this permit. The director of public safety <br />shall initiate said revocation or suspension. No permit <br />shall be suspended or revoked unless notice and an <br />opportunity to be heard have been provided the holder of
