Each such per- <br />son shall be deemed guilty of a separate offense <br />for each and every day or portion thereof during <br />which any violation of any of the provisions of this <br />code is committed or continued, and, upon conviction <br />of any such violation such person shall be punished <br />by a fine of not more than two hundred dollars ($200.00) <br />The imposition of the penalties herein prescribed <br />shall not preclude the City of San Marcos from in- <br />stituting an appropriate action or proceeding to pre- <br />vent an unlawful erection, construction, reconstruction, <br />alteration, repair, conversion, maintenance or use, <br />or to restrain, correct or abate a violation, or to <br />prevent the occupancy of a building or structure or <br />portion, thereof, or of the premises, or to prevent <br />an illegal act, conduct, business or use in or about <br />any premises. <br />Sec. 5-24. Chapter 3. <br />Chapter 3, Fire District, shall be deleted in its <br />entirety. <br />Sec. 5-25. Section 1302.1. <br />Section 1302.1 of said code is amended so that section <br />1302.1, "General" is deleted in its entirety and a new <br />subsection 1302.1 entitled "Minimum Foundation for Single <br />Family and Two Family Residential" is as follows: <br />a. Minimum requirements for a single story wood <br />frame residence containing less than 600 square <br />feet of habitable area shall be as follows: <br />Outside concrete beams 10" wide, 18" in depth <br />with two (2) #4 bars top and bottom, stirrups <br />every six feet; slab shall be minimum 3 5/8" <br />thick with #3 bars 18" on center both ways or <br />6" x 6" x 6" wire mesh; there shall be a cross <br />beam of area if slab is over 400 square feet; <br />cross beam to be 10" wide by 16" deep with two <br />(2) #4 bars top and bottom with stirrups every <br />six (6) feet; top of concrete slab shall be a <br />minimum 6" above finished grade of yard.
