Manifest. <br />Every driver of a vehicle operated pursuant to this article shall maintain a daily manifest upon <br />which are recorded all trips made each day, showing time and place of origin and destination <br />of each trip and the amount of fare. All completed manifests shall be returned to the <br />designated agent of the holder of a certificate of public convenience and necessity at the <br />conclusion of each tour of duty. The forms for each manifest shall be furnished to the driver by <br />the holder. The holder shall retain and preserve all drivers' manifests in a safe place for at least <br />the calendar year next preceding the current calendar year, and the manifests shall be <br />available to the city at all times. <br />(Code 1970, § 27-25) <br />Sec. 90.133. Holder's records and reports. <br />Every certificate holder shall keep accurate records of receipts from operations, operating and <br />other expenses, capital expenditures and any other operating information required by the city. <br />Every holder shall maintain the records containing this information and other data required by <br />this article at a place readily accessible for examination by the city. <br />(Code 1970, § 27-26) <br />Secs. 90.134--90.160. Reserved. <br />DIVISION 2. CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY <br />Sec. 90.161. Required. <br />No person shall engage, directly or indirectly, in the taxicab business upon the city streets <br />without having first obtained a certificate of public convenience and necessity from the city <br />council. <br />(Code 1970, § 27-2) <br />Sec. 90.162. Application. <br />An application for a certificate required in section 90.161 shall be filed with the city secretary <br />upon forms provided by the city. The application shall contain the following information: <br />(1) The name and address of the applicant. <br />(2) The financial status of the applicant, including the amounts of all unpaid judgments <br />against each applicant and the nature of the transaction or acts giving rise to the <br />judgments. <br />(3) If the applicant is a partnership, the information in subsections (1), (2) and (5) of this <br />section shall be provided for each partner. <br />(4) If the applicant is a corporation, the name and place of residence of all of the officers <br />of the corporation, a duly certified copy of its charter and bylaws, the amount of capital <br />stock, the character and value of its assets, its liabilities and the security therefor and, <br />if the corporation is a foreign corporation, a duly certified copy of its certificate of <br />authority to transact business in the state. <br />(5) The experience of the applicant in the transportation of passengers. <br />(6) Any facts the applicant believes tend to prove that public convenience and necessity <br />require the granting of a certificate.
