• MOTION: Upon a motion made by Councilmember Jones and a second by Councilmember <br />Couch, the City Council voted six (6) for and one (1) opposed, with Councilmember Bose voting <br />against, to approve the ordinance on the first of two readings. The motion carried. <br />Brian Montgomery, 106 Bogie, President of the Downtown Association stated that the <br />association strongly supports the ordinance. He requested that the Council not place additional <br />fees or burdens on the area businesses. He also asked that the Council consider the impact on <br />restaurants operating under a Conditional Use Permit because the extended hours may lead to <br />increased alcoholic sales. Those subject to the 50% food rule should not be penalized for <br />operating downtown. He also requested that wine be included. The City Attorney responded <br />that, the way the ordinance is written, wine is already included. <br />25. Consider adoption on second and final reading of Ordinance 2009-23, amending <br />Chapter 14, Buildings and Building Regulations, Article 6, Plumbing Code of the San <br />Marcos City Code to change standards and requirements for irrigation systems; providing <br />for penalties; and, including procedural provisions. <br />MOTION: Upon a motion made by Councilmember Jones and a second by Councilmember <br />Couch, the City Council voted seven (7) for and none (0) opposed, to adopt Ordinance 2009-23, <br />as previously captioned. The motion carried unanimously. <br />26. Consider adoption of Resolution 2009-67R, approving a contract with Green Guy <br />• Recycling, Inc. for the operation of a recycling drop-off center and the provision of <br />recycline material pick up from City facilities in an estimated annual amount of <br />$173,400.00; authorizing the City Manager to execute this agreement on behalf of the City <br />and declaring an effective date. <br />MOTION: Upon a motion made by Councilmember Thomaides and a second by <br />Councilmember Jones, the City Council voted seven (7) for and none (0) opposed, to adopt <br />Resolution 2009-67R, as previously captioned. The motion carried unanimously. <br />27. Discussion and update on the City's efforts in securine federal economic stimulus <br />funding, and provide direction to staff. This item was moved to 6:00 p.m. <br />Melissa Millecam, Director of Communications and Intergovernmental Relations, provided an <br />update on the American Recovery and Reinvestment Act. She explained that the purpose of the <br />act is to stimulate the economy with jobs, tax relief, education and training, health care, energy, <br />etc. The City of San Marcos has applied for $96 million, which will help create 461 jobs. The <br />proposed City projects involve community development, neighborhood stabilization, public <br />safety, energy efficiency, transportation, and infrastructure. She stated that the City is working <br />hard to pursue economic stimulus funding opportunities, and the process, though complex, will <br />be transparent. <br /> 28.
