• 12. Consider adoption on second and final reading of Ordinance 2009-25, amending <br />Section 2.041 of the San Marcos City Code to set the first Monday in November as a <br />regular council meeting date; including procedural provisions; and providing an effective <br />date. <br />13. Consider adoption on second and final reading of Ordinance 2009-26, extending the <br />hours for the sale of beer and mixed beverages for on-premises consumption; providing for <br />periodic review of the effectiveness of this ordinance and its impact on the community; <br />reserving the City's right to repeal this ordinance, providing for amendment of conditional <br />use permits previously issued for on-.premise consumption of alcoholic beverages to allow <br />the sale of beer and mixed beverages during the late hours hereby adopted; including <br />procedural provisions and declaring an effective date. <br />14. Consider adoption of Resolution 2009-68R, approving a license agreement with the <br />Edwards Aquifer Authority (the "Authority") for access across and upon 8.939 acres of <br />land owned by the City to enable the Authority to protect the integrity of, restrict public <br />access to and conduct water monitoring and other investigations from a cave located on <br />such land; authorizing the Citv Manager to execute the license agreement on behalf of the <br />City; and declaring an effective date. <br />15. Consider adoption of Resolution 2009-69R, approving the purchase from Randall <br />Morris & Company, Ltd. of three tracts of real property consisting of six acres out of the <br />• T.J. or Thomas J. Chambers Survey as more particularly described by metes and bounds <br />in the attached special warranty deed for a price of $61,200.00; authorizing the transfer of <br />title to such tracts of land by special warranty deed; and declaring an effective date. <br />16. Consider adoption of Resolution 2009-70R, awarding a construction contract to QA <br />Construction Services, Inc. for the repair of metal and membrane roofs at City Facilities <br />Proiect in the amount of $193,000.00 contingent upon the bidder's timely submission of <br />sufficient bonds and insurance in accordance with the City's bid documents for the proiect; <br />authorizing the City Manager to execute the contract documents on behalf of the City and <br />declaring an effective date. <br />17. Consider adoption of Resolution 2009-71R, awarding a construction contract to Ideal <br />Skateparks for the Skate Park Proiect-Phase 1-A in the amount of $210,809.75 contingent <br />upon the bidder's timely submission of sufficient bonds and insurance in accordance with <br />the City's bid documents for the proiect; authorizing the City Manager to execute the <br />contract documents on behalf of the City and declaring an effective date. <br />18. Consider adoption of Resolution 2009-72R, ratifying the submission of a Neighborhood <br />Stabilization Grant to the Texas Department of Housing and Community Affairs, <br />authorizing the City Manager to execute the grant agreement; and declaring an effective <br />date. <br />• 19.
