Consider setting May 21, 2009 at 5:00 p.m. for a Budget Workshop. <br />Items 13 and 18 were pulled from the Consent Agenda. <br />MOTION: Upon a motion made by Councilmember Terry and a second by Councilmember <br />Jones, the City Council voted five (5) for and none (0) opposed, to approve the Consent Agenda, <br />less items 13 and 18. The motion carried unanimously. <br />(13)MOTION: Upon a motion made by Councilmember Jones and a second by Councilmember <br />Porterfield, the City Council voted five (5) for and none (0) opposed, to approve Ordinance <br />2009-26, as previously captioned. The motion carried unanimously. <br />(18)MOTION: Upon a motion made by Councilmember Jones and a second by Councilmember <br />Porterfield, the City Council voted five (0) for and none (0) opposed, to approve Resolution <br />2009-72R, as previously captioned. The motion carried unanimously. <br />END OF CONSENT AGENDA <br />21. Public Hearing to receive comments for and against an amendment to Chapter 54, • <br />Miscellaneous Offenses of the San Marcos City Code by adopting Article 3, Curfew, <br />creating curfew hours for minors; setting out violations and defenses; establishing penalties <br />for the violation thereof; providing for publication; and declaring an effective date; and <br />consider adoption of ordinance on the first of two readings. <br />At approximately 8:05 p.m. Mayor Narvaiz opened the Public Hearing. There being no <br />comment, the Public Hearing was closed at 8:05 p.m. <br />MOTION: Upon a motion made by Councilmember Jones and a second by Councilmember <br />Terry, the City Council voted five (5) for and none (0) opposed, to approve the ordinance on the <br />first of two readings. The motion carried unanimously. <br />22. Public Hearing to receive comments for and against the 2009 CDBG Action Plan, and <br />consider date for the CDBG application workshop to grant application submittals. <br />At approximately 8:06 p.m. Mayor Narvaiz opened the Public Hearing. <br />Ryan Patrick Perkins, 727 W. Hopkins, stated that the historical districts are barely as old as the <br />neighborhoods themselves, and some stretch back 200 years. The focus of the plan is on Victory <br />Gardens, and he can't understand this area is not being considered. This area is comprised of <br />low-to-middle income families and is one of the most visited areas of San Marcos, but a majority • <br />of the streets have not seen any improvements.
