City Council Meeting Minutes - Final November 2, 2015 <br />Against: 0 <br />Absent: 1 - Thomason <br />16. Consider approval of Ordinance 2015 -50, on the first of two readings, amending <br />Chapter 82, Article 1 of the San Marcos City Code by prohibiting the use of a portable <br />electronic device to engage in a call, or send, read or write a text message, or engage <br />in any other use of the device while operating a moving motor vehicle or bicycle within <br />the city limits of San Marcos, Texas; providing a penalty; providing a savings clause; <br />providing for the repeal of any conflicting provisions; providing for publication; and <br />providing an effective date. <br />Main Motion: A motion was made by Council Member Prewitt, seconded by <br />Deputy Mayor Pro Tem Scott, that Ordinance 2015 -50 be approved, on the <br />first of two readings. <br />Motion to amend: A motion was made by Council Member Thomaides, <br />seconded by Mayor Pro -Tem Prather, that Ordinance 2015 -50 Section 6 be <br />amended as follows, "This ordinance will take effect after its passage, approval <br />and adoption on second reading and publication within 10 days, the effective <br />date of the ordinance March 1, 2016, so that an educational effort by the city <br />may be conducted to inform the public about the importance and requirements <br />of the ordinance ". The motion carried by the following vote: <br />For: 5 - Mayor Pro -Tem Thomaides, Scott, Council Member Prather, Deputy Mayor Pro <br />Tem Prewitt and Council Member Hughson <br />Against: 1 - Mayor Guerrero <br />Absent: 1 - Thomason <br />Main Motion: that Ordinance 2015 -50 be approved on the first of two <br />readings as amended. The motion carried by the following vote: <br />For: 6 - Mayor Guerrero, Mayor Pro -Tem Thomaides, Scott, Council Member Prather, <br />Deputy Mayor Pro Tem Prewitt and Council Member Hughson <br />Against: 0 <br />Absent: 1 - Thomason <br />17. Consider approval of Resolution 2015 -154R, approving the conveyance of portions of <br />City property along Sessom Drive and Vista Street to Texas State University in <br />exchange for adjacent property and easements necessary to facilitate the realignment <br />of Sessom Drive and various utilities in connection with the construction of street, <br />sidewalk, utility, bicycle and pedestrian improvements along Sessom Drive; <br />authorizing the City Manager to execute deeds as necessary to convey such property, <br />to Texas State University on behalf of the City; and declaring an effective date. <br />A motion was made by Deputy Mayor Pro Tem Scott, seconded by Council <br />City of San Marcos Page 6 <br />
