City Council Meeting Minutes November 17, 2015 <br />change the Land Use <br />Designation for <br />83.657 acres, more or <br />less, of land out of The <br />Blanco Riverwalk Subdivision comprised <br />of Block A, Block B <br />And Block E and located <br />along the west side <br />of IH -35 between <br />Carlson Circle and <br />Yarrington Road from an <br />Area Of Stability/Low <br />Intensity to an <br />Employment Center; <br />and including procedural <br />provisions. <br />6. Consider approval of Ordinance 2015-49, on the second of two readings, amending <br />Section 74.027 of the San Marcos City Code to allow temporary street closures for <br />certain purposes; providing for the repeal of any conflicting provisions; and providing <br />an effective date. <br />Main Motion: a motion was made by Mayor Pro -Tem Thomaides, seconded by <br />Deputy Mayor Pro Tem Prewitt, to approve Ordinance 2015-49, as captioned. <br />Motion to Amend: a motion was made by Council Member Gregson, seconded <br />by Council Member Prather, to amend this Ordinance by inserting the words <br />"for purposes including but not limited to the following." The motion carried <br />by the following vote: <br />For: 7 - Mayor Guerrero, Mayor Pro -Tem Thomaides, Council Member Prather, Deputy <br />Mayor Pro Tem Prewitt, Council Member Hughson, Council Member Derrick and <br />Council Member Gregson <br />Against: 0 <br />Main Motion: to approve Ordinance 201549 as amended.The motion carried <br />by the following vote: <br />For: 7 - Mayor Guerrero, Mayor Pro -Tem Thomaides, Council Member Prather, Deputy <br />Mayor Pro Tem Prewitt, Council Member Hughson, Council Member Derrick and <br />Council Member Gregson <br />Against: 0 <br />7. Consider approval of Ordinance 2015-50, on the second of two readings, amending <br />Chapter 82, Article 1 of the San Marcos City Code by prohibiting the use of a portable <br />electronic device to engage in a call, or send, read or write a text message, or engage <br />in any other use of the device while operating a moving motor vehicle or bicycle within <br />the city limits of San Marcos, Texas; providing a penalty; providing a savings clause; <br />providing for the repeal of any conflicting provisions; providing for publication; and <br />providing an effective date. <br />Main Motion: a motion was made by Mayor Pro -Tem Thomaides, seconded by <br />Deputy Mayor Pro Tem Prewitt, to approve Ordinance 2015-50, as captioned. <br />Motion to Amend: A motion was made by Council Member Hughson, seconded <br />by Council Member Derrick, to amend this Ordinance to include the following <br />in Section (h): "except as otherwise provided by this article or state law, an <br />offense under this article is a Class C misdemeanor punishable by a fine not to <br />exceed $100 for the first offense, $250 for the second offense, and $500 for the <br />City of San Marcos Page 3 <br />
