City Council Meeting Minutes November 17, 2015 change the Land Use Designation for 83.657 acres, more or less, of land out of The Blanco Riverwalk Subdivision comprised of Block A, Block B And Block E and located along the west side of IH -35 between Carlson Circle and Yarrington Road from an Area Of Stability/Low Intensity to an Employment Center; and including procedural provisions. 6. Consider approval of Ordinance 2015-49, on the second of two readings, amending Section 74.027 of the San Marcos City Code to allow temporary street closures for certain purposes; providing for the repeal of any conflicting provisions; and providing an effective date. Main Motion: a motion was made by Mayor Pro -Tem Thomaides, seconded by Deputy Mayor Pro Tem Prewitt, to approve Ordinance 2015-49, as captioned. Motion to Amend: a motion was made by Council Member Gregson, seconded by Council Member Prather, to amend this Ordinance by inserting the words "for purposes including but not limited to the following." The motion carried by the following vote: For: 7 - Mayor Guerrero, Mayor Pro -Tem Thomaides, Council Member Prather, Deputy Mayor Pro Tem Prewitt, Council Member Hughson, Council Member Derrick and Council Member Gregson Against: 0 Main Motion: to approve Ordinance 201549 as amended.The motion carried by the following vote: For: 7 - Mayor Guerrero, Mayor Pro -Tem Thomaides, Council Member Prather, Deputy Mayor Pro Tem Prewitt, Council Member Hughson, Council Member Derrick and Council Member Gregson Against: 0 7. Consider approval of Ordinance 2015-50, on the second of two readings, amending Chapter 82, Article 1 of the San Marcos City Code by prohibiting the use of a portable electronic device to engage in a call, or send, read or write a text message, or engage in any other use of the device while operating a moving motor vehicle or bicycle within the city limits of San Marcos, Texas; providing a penalty; providing a savings clause; providing for the repeal of any conflicting provisions; providing for publication; and providing an effective date. Main Motion: a motion was made by Mayor Pro -Tem Thomaides, seconded by Deputy Mayor Pro Tem Prewitt, to approve Ordinance 2015-50, as captioned. Motion to Amend: A motion was made by Council Member Hughson, seconded by Council Member Derrick, to amend this Ordinance to include the following in Section (h): "except as otherwise provided by this article or state law, an offense under this article is a Class C misdemeanor punishable by a fine not to exceed $100 for the first offense, $250 for the second offense, and $500 for the City of San Marcos Page 3
