<br /> 53 <br />Regular Meeting June 8, 1992 Page 7 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, AMENDING APPENDIX A-GENERAL ZONING <br /> ORDINANCE OF THE CODE OF ORDINANCES OF THE CITY BY <br /> AMENDING SECTION 26(B) REGARDING THE ADDITION OF <br /> FRATERNITY AND SORORITY BUILDINGS AS A SPECIFIC USE IN <br /> THE PUBLIC AND INSTITUTIONAL DISTRICT, AND BY AMENDING <br /> SECTION 35(G) AND (H) REGARDING THE SPECIFIC USE PERMIT <br /> PROCEDURE AND STANDARDS FOR FRATERNITY AND SORORITY <br /> BUILDINGS; PROVIDING FOR APPLICATION OF THE PERMIT <br /> PROCEDURES AND STANDARDS TO EXISTING FRATERNITY AND <br /> SORORITY BUILDINGS; REPEALING ALL CONFLICTING ORDINANCES; <br /> PROVIDING A PENALTY; PROVIDING FOR PUBLICATION; AND <br /> PROVIDING AN EFFECTIVE DATE. <br />Mr. Hart asked if anyone wished to speak on this item. Mr. Guerra <br />stated that he recommended that the Council try not to rehash what <br />they had spoken about already. Mr. Plummer moved for adoption of <br />the Ordinance on second reading and Mr. Moore seconded the motion. <br />Mr. Hart moved that the Ordinance be amended on Page 3, Subdivision <br />6 to read as follows: "Social functions shall not be held or <br />conducted during the following hours: (a) between 11:00 p.m. and <br />midnight on a Sunday, Monday, Tuesday, Wednesday or Thursday; (b) <br />between midnight and 7:00 a.m. on a Monday, Tuesday, Wednesday, <br />Thursday or Friday; or (c) between 1: 00 a.m. and 7: 00 a.m. on a <br />Saturday or Sunday." Also to amend Page 5, subdivision (g) amend <br />the second and third sentences as follows: "If the Specific Use <br />Permit is revoked the use of the building as a fraternity or <br />sorority building by the organization to which the permit was <br />issued shall cease within thirty (30) days of the date of the <br />decision of the Commission. If the permit is not revoked continued <br />use of the fraternity or sorority building by the permitted <br />organization may be subject to additional conditions reasonably <br />related to the circumstances giving rise to the revocation hearing <br />as determined by the Commission and the permit is again subject to <br />the revocation if one or more additional penalty points are <br />assessed during any probationary period established by the <br />Commission in its decis ion." In addi tion Mr. Hart stated that <br />another amendment would be on Page 6, subdivision (h) (1) to read as <br />follows: (1) the use of an amplified sound system indoors or <br />outdoors which is audible from any property line of the premises; <br />or". Mr. Moore seconded the motion. On roll call for Mr. Hart's <br />amendment ,the following vote was recorded: <br /> Aye; Guerra, Plummer, Moore, Hernandez, Hart <br /> Nay: None <br />Mr. Guerra moved to repeal (a) on Page 3 subdivision 6 and to <br />extend the time to 12:00 midnight and to renumber (b) and (c) to <br />(a) and (b). Mr. Moore seconded the motion. Ms. Hughson spoke on <br />behalf of the Zoning Commission. Ms. Hughson stated that the 11:00 <br />o'clock p.m. curfew would help with neighborhood concerns. Ms. <br />Fitzpatrick stated that she felt very strongly about staying with <br />the 11:00 0' clock p.m. hour. Mr. Moore stated that it was the <br />strong recommendation of the Zoning Commission based on the <br />information required at the hearings that the Council stick with <br />the 11:00 o'clock p.m. hour. The following vote was recorded for <br />the amendment: <br /> Aye: Guerra <br /> Nay: Moore, Hernandez, Hart, Plummer <br />Motion failed. <br />Mr. Dan Medlin stated that he was at the meeting to serve as a <br />liaison between the Fraternities Roundtable and the City. Mr. <br />Medlin stated that he was asked to come here tonight in reference <br />to the letter recently sent to Mayor Morris which was requested to <br />
