2 Regular Meeting February 27, 1995 Page 2 Mayor Morris introduced for consideration a public hearing and adoption of a Zoning Ordinance, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY 'BY REZONING A 0.333 ACRE TRACT OF PROPERTY, LOCATED AT 401 JACKMAN STREET ~ FROM UP" (PUBLIC AND INSTITUTIONAL DISTRICT) TO "R-1" ¡ (SINGLE-FAMILY DWELLING DISTRICT [LOW DENSITY]) AND DECLARING ¡ AN EFFECTIVE DATE. ' Mayor Morris opened the public hearing and asked if anyone wished to speak for or against the zoning amendment. No one did, so Mayor Morris closed the public hearing. Mr. Cox moved for adoption of the Zoning Ordinance and Mr. Hernandez seconded the motion. On roll call the following vote was recorded: AYE: Moore, Mooney, Morris, Cox, Hernandez. NAY: None. ABSTAIN: Hart (abstain because of working relationship with owner Russell Smith). ~ Mayor Morris introduced for consideration a public hearing and adoption of a Zoning Ordinance, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 3.072 ACRE TRACT OF PROPERTY, LOCATED AT 1637 POST ROAD FROM "C" (COMMERCIAL DISTRICT) TO "MF-4" (MULTI-FAMILY DISTRICT [HIGH DENSITY]); AND DECLARING AN EFFECTIVE DATE. i I Mayor Morris opened the public hearing and asked if anyone wished to speak. No one wished to speak, so Mayor Morris closed the public hearing. Mr. Hart moved for adoption of the Zoning Ordinance and Mr. Moore seconded the motion, which passed unanimously. Mayor Morris introduced for consideration adoption of an Ordinance on emergency, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE CITY BUDGET ORDINANCE FOR THE 1994-1995 FISCAL YEAR TO PROVIDE FUNDING FOR THE SAN MARCOS - A TEXAS NATURAL PROGRAM; AND DECLARING AN EMERGENCY. Mr. Moore moved for adoption of the Ordinance on emergency and Mr. Hart seconded the motion, which passed unanimously. Mayor Morris introduced for consideration adoption of an Ordinance on third and final reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, UPDATING AND CLARIFYING CHAPTER 6, CEMETERIES, OF THE SAN MARCOS CODE OF ORDINANCES; PROVIDING FOR SEVERABILITY; REPEALING ALL CONFLICTING ORDINANCES; PROVIDING A PENALTY; i PROVIDING FOR PUBLICATION AND PROVIDING AN EFFECTIVE DATE. ¡ , ~ I Mr. Moore moved for adoption of the Ordinance on third and final - reading and Mr. Mooney seconded the motion. Mayor Morris moved to amend Section 6-13 to read, "Section 6-13. Use of Dixon Addition, Section I [deletion]. ----- "(a) Lots in Dixon Addition, Section I [deletion] shall be sold in regular-order as shown on the plat on file at the cemetery for an amount set by separate ordinance. Specific [deletion] lots cannot be reserved in the Dixon Addition, Section I except. that ~ relative in the immediate family of ~ person interred in Dixon Addition, Section I may purchase ~ vacant lot next to the interred person for an amount set ÈY separate ordinance.
