City Council Meeting Minutes May 3, 2016 <br />designation for a 4.78 acre, more or less, tract of land out of the J.M. Veramendi <br />survey, located at the Southwest Corner of IH -35 and East River Ridge Parkway, from <br />an Area of Stability to Employment Center; and including procedural provisions; and <br />providing an effective date. <br />6. Consider approval of Ordinance 2016 -11, on the second of two readings, amending <br />various sections of the Land Development Code as follows: amending Section 2.1.1.1 <br />to clarify what standards from Chapter 6 apply in the Extraterritorial Jurisdiction of the <br />City; amending the Land Use Matrix in Section 4.3.1.2 to make hospitals a permitted <br />use in areas zoned as (P) Public and Institutional Districts and to add Senior Housing <br />Community as a new land use under the Residential Uses Section of the Matrix; <br />amending Section 6.2.1.2 to add Minimum Off - Street Parking Requirements for Senior <br />Housing Communities; and amending Chapter 8, Article 2, to add a new definition for <br />Senior Housing Community; providing a savings clause; providing for the repeal of any <br />conflicting provisions; and providing an effective date. <br />7. Consider approval of Ordinance 2016 -12, on the second of two readings, amending <br />Chapter 86, Article 8 of the San Marcos City Code regarding the City's Drainage Utility <br />by adding supplemental regulations and standards for controlling the introduction of <br />pollutants into the Municipal Separate Storm Sewer System (MS4) as part of the City's <br />Stormwater Management Plan; providing for penalties; providing a savings clause; <br />providing for the repeal of any conflicting provisions; and providing an effective date. <br />A motion was made by Mayor Pro -Tem Thomaides, seconded by Council <br />Member Gregson, to approve Ordinance 2016 -12, on the second of two <br />readings. Staff will research and bring back suggestions to Council at a later <br />date regarding fees for yearly inspections under the MS4. The motion carried <br />by the following vote: <br />For: 7 - Mayor Guerrero, Mayor Pro -Tem Thomaides, Council Member Prather, Deputy <br />Mayor Pro Tern Prewitt, Council Member Hughson, Council Member Derrick and <br />Council Member Gregson <br />Against: 0 <br />8. Consider approval of Ordinance 2016 -13, on the second of two readings, amending <br />Division 10, Cemetery Commission, of Chapter 2, Article 3 of the San Marcos City <br />Code to convert the Cemetery Commission to a Council appointed commission; <br />providing for the repeal of any conflicting provisions; and providing an effective date. <br />9. Consider approval of Resolution 2016 -56R, approving an amendment to the amended <br />and restated water utility agreement with Carma Blanco Vista, L.L.C., formerly Carma <br />Blanco Vista, Ltd. ( Carma), approved by Resolution 2007-161R for purposes of <br />adjusting the method for reimbursing Carma for the costs of the Post Road Waterline; <br />authorizing the City Manager to execute this amendment on behalf of the City; and <br />declaring an effective date. <br />10. Consider approval of Resolution 2016 -59R, approving a lease of airport property for <br />agricultural use with Curby D. Ohnheiser for a term of three years; authorizing the City <br />City of San Marcos Page 4 <br />
