<br /> 161 <br />Regular Meeting February 13, 1995 Page 3 <br />Mayor Morris introduced for consideration a public hearing and <br />adoption of a Zoning ordinance, the caption which was read as <br />follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING <br /> A 0.941 ACRE TRACT OF PROPERTY, LOCATED IN THE 400 BLOCK OF <br /> SESSOM DRIVE, FROM "R-1" (SINGLE-FAMILY DWELLING DISTRICT [LOW <br /> DENSITY]) TO "LB" (LIMITED BUSINESS DISTRICT) AND DECLARING AN <br /> EFFECTIVE DATE. <br />Mayor Morris opened the public hearing and asked if anyone wished to <br />speak in favor of the zoning amendment. No one did, so Mayor Morris <br />closed the public hearing. Mr. Hernandez moved for adoption of the <br />zoning Ordinance and Mr. Mooney seconded the motion, which passed <br />unanimously. <br />Mayor Morris introduced for consideration adoption of an Ordinance <br />on emergency, the caption which was read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, ORDERING A JOINT GENERAL AND SPECIAL ELECTION BY THE <br /> CITY AND THE SAN MARCOS CONSOLIDATED INDEPEND~NT SCHOOL <br /> DISTRICT TO BE HELD ON MAY 6, 1995 FOR THE PURPOSE OF ELECTING <br /> A CITY COUNCIL MEMBER, PLACE ONE, AND A CITY COUNCIL MEMBER, <br /> PLACE TWO, AND TO BE HELD WITHIN THE BOUNDARIES OF THE SCHOOL <br /> DISTRICT FOR THE PURPOSE OF ELECTING A SCHOOL DISTRICT BOARD OF <br /> TRUSTEES MEMBER, PLACE 4, AND A SCHOOL DISTRICT BOARD OF <br /> TRUSTEES MEMBER, PLACE 5, FOR TERMS OF THREE YEARS EACH, AND TO <br /> FILL A VACANCY FOR A ONE YEAR TERM IN SCHOOL DISTRICT BOARD OF <br /> TRUSTEES MEMBER, PLACE TWO¡ ESTABLISHING POLLING PLACES FOR <br /> THIS ELECTION MAKING PROVISIONS FOR THE CONDUCT OF THE <br /> ELECTION¡ AND DECLARING AN EMERGENCY. <br />Mr. Moore moved for adoption of the Ordinance on emergency and Mr. <br />Mooney seconded the motion, which passed unanimously. <br />Mayor Morris introduced for consideration adoption of an Ordinance <br />on emergency, the caption which was read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN ,MARCOS, <br /> TEXAS, AMENDING THE CITY BUDGET ORDINANCE FOR THE 1994-1995 <br /> FISCAL YEAR TO PROVIDE FUNDING FOR REPAIRS TO THE CONFEDERATE <br /> AIR FORCE HANGAR AT THE SAN MARCOS MUNICIPAL AIRPORT¡ AND <br /> DECLARING AN EMERGENCY. <br />Mr. Moore moved for adoption of the Ordinance on emergency and Mr. <br />Mooney seconded the motion. James Lux stated they are trying to <br />make improvements. He stated the air show will celebrate the 50th <br />Anniversary of the end of World War II and will be in recognition of <br />veterans. The Council voted unanimously for adoption of the <br />Ordinance on emergency. <br />Mayor Morris introduced for consideration reconsideration of an <br />Ordinance adopted on third and final reading on January 23, 1995, <br />the caption which was read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, AMENDING ARTICLE II, DEFINITIONS, AND ARTICLE VI, <br /> SUBDIVISION DESIGN REQUIREMENTS, OF APPENDIX C, SUBDIVISIONS, <br /> OF THE SAN MARCOS CODE OF ORDINANCES TO DEFINE "FLAG SHAPED <br /> LOTS" AND TO PROHIBIT SUCH LOTS WITHIN SUBDIVISIONS, INCLUDING <br /> PROCEDURAL PROVISIONS¡ AND PROVIDING PENALTIES FOR VIOLATIONS. <br />Mr. Moore moved for reconsideration of the Ordinance and Mr. Cox <br />seconded the motion, which passed unanimously. Mayor Morris moved <br />to approve the Ordinance as presented so discussion could ensue and <br />Mr. Hart seconded the motion. Mayor Morris stated she is extremely <br />concerned with this limitation and does not want to see flag-shaped <br />lots allowed in residential development but does see a need to allow <br />this in commercial development and thinks this limitation will <br />actually limit commercial development.
