<br />3 <br /> <br /> <br />Regular Meeting April 11, 1994 Page 3 <br /> <br />Mr. Cox expressed concern the City is putting a greater <br />concentration of Housing Authority homes in the Dunbar area than <br />maybe we should with the zonings on this agenda. Mr. Cox stated we <br />needed to look at the overall future health of the neighborhood. <br />The Housing Authority homes will be rental/owner property through <br />HUD. <br /> <br />Mayor Morris introduced for consideration Item 7.G., a public <br />.~ hearing and adoption of a Zoning Ordinance, the caption which was <br />¡ read as follows: <br />I <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING <br />A 0.45 ACRE TRACT OF PROPERTY, LOCATED AT 616 MARTIN LUTHER <br />KING DRIVE, FROM "MF-4" (MULTI-FAMILY DISTRICT [HIGH DENSITY]) <br />TO uP" (PUBLIC AND INSTITUTIONAL DISTRICT) AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />Mayor Morris opened the public hearing and asked if anyone wished to <br />speak. Ollie Giles recommended the zoning request be approved so <br />the building could be moved to the property. Kyev Tatum recommended <br />to the Council approval of the zoning request. Fred White wants the <br />zoning change denied. Jeff Kester said he was in favor of the <br />zoning change. Herman Foster asked the Council to give. <br />consideration to the merit of the project and app~ove the zoning <br />change. Pat Spearman requested the Council favorably consider the <br />usage. She stated although she does not reside in the Dunbar. <br />neighborhood, she does deal with the Dunbar residents. She stated <br />she helped clean up lots in that neighborhood in the Fall, and the <br />neighborhood is concerned with its appearance and thinks this <br />project will help that community. Rev. Thomas Ates stated he is a <br />resident of Dunbar and wants the Council to consider rezoning the <br />property. He stated this project is sorely needed and will enrich <br />the lives of many. Kyev Tatum requested the Council consider the <br />rezoning change with the land use amendment approved. Barbara <br />Rennicks stated she is opposed to the zoning change. Paul Terry <br />stated there is a lot of traffic on MLK, and he does not think <br />public use of this property would increase the traffic <br />significantly. He is in favor of the zoning request. Rose Brooks <br />stated she is in favor of the zoning request. Dolores crittendon <br />stated she does not live in Dunbar but stated there is a need for <br />all the education and counseling we can provide for the youth in <br />this community. Lorraine Burleson stated she does not live in <br />Dunbar but thinks there is a need to revitalize the area. Sue <br />Williams stated she lives across from the Dunbar Recreation Center. <br />She wants this building moved back to the neighborhood for the <br />children to have a place to go. No one else wished to speak, and <br />Mayor Morris closed the public hearing. Mr. Plummer stated the <br />zoning request is what is at issue and not the project. Mr. Cox <br />stated he has the same concerns as Mr. Plummer. He is in favor of <br />the project and expressed the City has the responsibility to the <br />neighbors that the property be maintained in a high quality way. <br />Ron Patterson stated the agreement could be amended to include some <br />protection, buffering and times of use of the building. On roll <br />call the following vote was recorded: <br /> <br />AYE: Moore, Hart, Morris, Guerra, Cox. <br /> <br />. NAY: Plummer. <br /> <br />ABSTAIN: None. <br /> <br />The motion failed, because the Zoning commission denied this request <br />for rezoning, which would require 6 votes of approval of the city <br />Council to approve this zoning request. <br /> <br />Because the land use amendment was approved and the zoning request <br />was denied, Mr. Hart moved to reconsider the land use amendment in <br />order for the zoning and land use to be in conformity and Mr. Guerra <br />seconded the motion. Since the Zoning Ordinance will automatically <br />be placed on the next regular meeting agenda for reconsideration, <br />Mr. Hart withdrew his motion and Mr. Guerra his second to be placed <br />on the next regular agenda following the reconsideration of the <br />zoning Ordinance. <br />
