<br /> 16 <br />Regular Meeting July 25/ 1994 Page 3 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, AMENDING THE CITY BUDGET ORDINANCE FOR THE 1993-1994 <br /> FISCAL YEAR TO PROVIDE FUNDING FOR A STAFF EXPANSION FOR THE <br /> WOMEN, INFANTS AND CHILDREN'S PROGRAM; AND DECLARING AN <br /> EMERGENCY. <br />Mr. Moore moved for adoption of the Ordinance on emergency and Mr. <br />Mooney seconded the motion, which passed unanimously. <br />Mayor Morris introduced for consideration adoption of an Ordinance <br />on emergency, the caption which was read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, AMENDING THE CITY BUDGET ORDINANCE FOR THE 1993-1994 <br /> FISCAL,YEAR TO PROVIDE FUNDING FOR PLAYGROUND EQUIPMENT IN THE <br /> HEB PARK; AND DECLARING AN EMERGENCY. <br />Mr. Moore moved for adoption of the Ordinance on emergency and Mr. <br />Mooney seconded the motion, which passed unanimously. <br />Mayor Morris introduced for consideration adoption of an Ordinance <br />on emergency, the caption which was read as follows: <br /> . <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, AMENDING THE CITY BUDGET ORDINANCE FOR THE 1993-1994 <br /> FISCAL YEAR TO PROVIDE FUNDING FOR THE LANDFILL GRADING <br /> PROJECT; AND DECLARING AN EMERGENCY. <br />Mr. Moore moved for adoption of the Ordinance on emergency and Mr. <br />Mooney seconded the motion. The Council requested a total of how <br />much has been spent on the landfill since 1984. The Council voted <br />unanimously for adoption of the Ordinance on emergency. <br />Mayor Morris introduced for consideration Item 9, approval of an <br />Ordinance on first reading, the caption which was read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, AMENDING CHAPTER 16, MISCELLANEOUS OFFENSES AND <br /> PROVISIONS, OF THE SAN MARCOS CODE OF ORDINANCES BY ADDING AN <br /> ARTICLE VII, CURFEW FOR MINORS; DEFINING HOURS OF CURFEW FOR <br /> MINORS; DEFINING OFFENSES FOR MINORS, PARENTS OF MINORS AND <br /> BUSINESS ESTABLISHMENTS VIOLATING CURFEW REGULATIONS; PROVIDING <br /> FOR SEVERABILITY; REPEALING ALL CONFLICTING ORDINANCES; <br /> PROVIDING FOR PENALTIES; PROVIDING FOR PUBLICATION AND <br /> PROVIDING AN EFFECTIVE DATE. <br />Mr. Hernandez moved for approval of the Ordinance on first reading <br />and Mr. Mooney seconded the motion. The San Marcos Ordinance has <br />been patterned from the Dallas Ordinance, which has withstood <br />federal challenge. Chief Kendrick stated he thinks they will have <br />the necessary manpower for the issuance of citations and is in hopes <br />the existence of the Ordinance will help parents and kids to do the <br />right thing. Mayor Morris moved to amend RECITAL 2 to read as <br />follows, liThe City Council believes that persons under the age of <br />seventeen are particularly susceptible to unlawful and gang related <br />activities and to be victims of older perpetrators of crime,1I and <br />Mr. Hernandez seconded the motion, which passed unanimously. Mayor <br />Morris stated she thought the reference to San Marcos Consolidated <br />Independent School District needed to be expanded to the area public <br />and private schools and wants a Staff recommendation at the next <br />meeting how this can be addressed. Mr. Hernandez stated when the <br />Youth Commission report was completed, the number one priority of <br />the youth serving on the Commission was the need to have a curfew. <br />Mayor Morris stated in Section 16-83 regarding enforcement, she <br />would like to see a provision citing parents to make them also be <br />responsible and wants this language incorporated at the next <br />meeting. The Council then voted unanimously for approval of the <br />Ordinance on first reading. <br />
