Ms. <br />Hughson asked if there were only a few birds exempt from state permit to dispose of from the <br />area and did they need to be listed in the City Ordinance. Mr. Taylor stated there were only a few ! <br />birds and he would have to review them with State Parks and Wildlife before redrafting. Mr. <br />Hernandez asked if a nest was in a tree on someone's property who wanted to build a home, <br />would they be prohibited from building. Mr. Taylor stated they would not be prohibited because <br />it was not considered an unlawful act to build a home. Mr. Hernandez expressed that he does not <br />want city ordinance to be more restrictive than state law. Mr. Hart stated he agreed and did not <br />feel property owners needed more red tape when building a home. Dick Henderson stated <br />Seguin has had an ordinance in place for years and has never created a problem. He stated the <br />Council was focusing on a worst case scenario and felt this simply needed to be on record. <br />Mayor Moore stated he felt the intent was for bird species and humans to co-habit.
