16 <br />Regular Meeting August 25, 1997 Page 3 <br />no speakers so Mayor Moore closed the public hearing. Mr. Cox moved for adoption of the <br />Zoning Ordinance and Mr. Hernandez seconded the motion which passed unanimously. <br />Mayor Moore introduced for consideration a public hearing and adoption of a Zoning <br />Ordinance, the caption of which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF <br />THE CITY BY REZONING AN 18.39 ACRE TRACT OF PROPERTY <br />LOCATED OFF OF THE 200 AND 300 BLOCKS OF WONDER <br />WORLD DRIVE FROM "R-2" SINGLE-FAMILY RESIDENTIAL <br />DISTRICT (MEDIUM DENSITY) TO "MF-4" MULTI-FAMILY <br />DISTRICT (HIGH DENSITY); INCLUDING PROCEDURAL <br />PROVISIONS; AND PROVIDING FOR PENALTIES. <br />Mayor Moore opened the public hearing and asked if anyone wished to speak. There were <br />no speakers so Mayor Moore closed the public hearing. Mr. Hernandez moved for <br />adoption of the Zoning Ordinance and Mr. Mihalkanin seconded the motion which passed <br />unanimously. <br />Mayor Moore introduced for consideration a public hearing and adoption of a Zoning <br />Ordinance, the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF <br />THE CITY BY REZONING A 0.19 ACRE TRACT OF PROPERTY <br />LOCATED AT 1025 DAILEY STREET FROM "R-1" SINGLE-FAMILY <br />RESIDENTIAL DISTRICT (LOW DENSITY) TO "MR" MOBILE HOME <br />RESIDENTIAL DISTRICT (LOW DENSITY); INCLUDING <br />PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. <br />Mayor Moore opened the public hearing and asked if anyone wished to speak. There were <br />no speakers so Mayor Moore closed the public hearing. Mr. Guerra moved to deny the <br />Zoning Ordinance and Ms. Hughson seconded the motion which passed unanimously. <br />Mayor Moore introduced for consideration a public hearing and adoption of an Ordinance <br />on first reading, the caption of which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING SECTION 114.022 OF THE ZONING <br />CHAPTER OF THE CITY CODE TO REQUIRE THE POSTING OF <br />NOTIFICATION SIGNS ON PROPERTY PROPOSED FOR A <br />ZONING CHANGE, ZONING VARIANCE OR SPECIAL USE <br />PERMIT; AMENDING SECTION 114.025 OF THE ZONING <br />CHAPTER OF THE CITY CODE TO PROVIDE THAT THE <br />EXTRAORDINARY MAJORITY VOTE REQUIREMENT ONLY <br />APPLIES TO CITY COUNCIL DECISIONS TO OVERRULE <br />RECOMMENDATIONS FOR DENIAL OF ZONING CHANGES BY <br />THE PLANNING AND ZONING COMMISSION; AMENDING <br />SECTION 114.577 OF THE ZONING CHAPTER OF THE CITY <br />CODE TO PROVIDE ONE-YEAR AND TWO-YEAR TERMS FOR <br />HOME OCCUPATION SPECIFIC USE PERMITS; INCLUDING <br />PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. <br />Mayor Moore opened the public hearing and asked if anyone wished to speak. There were <br />no speakers so Mayor Moore closed the public hearing. Mayor Moore stated the purpose <br />of the notification signs is to inform the entire community and the neighborhood within the <br />notification area that a change in use is being proposed and to give them an opportunity <br />to review and respond to it.
