65 <br />Special Meeting December 15, 1997 Page 2 <br />Mayor Moore introduced for consideration a public hearing and adoption of a Zoning Ordinance, <br />the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING <br />A 0.188 ACRE TRACT OF PROPERTY LOCATED IN THE 500 BLOCK OF VALLEY <br />STREET FROM "M" (SINGLE-FAMILY, DUPLEX AND NEIGHBORHOOD <br />BUSINESS DISTRICT) TO "MR" MOBILE HOME AND RESIDENTIAL DISTRICT; <br />INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. <br />Mayor Moore opened the public hearing and asked if anyone wished to speak. Amos Perkins <br />stated he is requesting this zoning change because he would like to put a double wide mobile <br />home on this property he purchased from the City. There were no other speakers so Mayor <br />Moore closed the public hearing. Mr. Guerra moved for adoption of the Ordinance and Ms. <br />Hughson seconded the motion, which passed unanimously. <br />Mayor Moore introduced for consideration adoption of an Ordinance on third reading, the <br />caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING SECTION 102.029 OF THE CITY CODE BY ADOPTING THE <br />SECTOR TWO PLAN; INCLUDING PROCEDURAL PROVISIONS; AND <br />PROVIDING FOR PENALTIES. <br />Ms. Hughson stated she would be abstaining on this item because her homestead adjoins the <br />property most under controversy in Sector Two and removed herself from the Chambers. Mr. <br />Hernandez moved for adoption of the Ordinance on third and final reading and Mr. Mihalkanin <br />seconded the motion. John McBride passed out a letter regarding litigation from different Cities <br />in regard to zoning and land use and discussed several cases. Jake Issac, Oak Heights <br />Neighborhood, encouraged the passage of amendments 3-9 and 12 in the handout presented by <br />Mr. Patterson. He also suggested language change in amendment 7 regarding density. He stated <br />in amendment 12 they would also like to remain with low density. Dr. Jack Weatherford <br />requested the Council adopt the original charrette plan. Mr. Guerra asked if the Council agreed <br />on "PDD" this could be handled internally. Mr. Patterson stated yes. It was the consensus of the <br />Council to go with "PDD" zoning. Mr. Mihalkanin moved to amend Page 3-3, Section Two to <br />add the following "All uses permitted in the table shown above shall be implemented through the <br />submittal of one or more Planned Development District (PDD) zoning cases" and Mr. Hart <br />seconded the motion, which passed unanimously. Mr. Mihalkanin moved to amend Page 3-3, <br />Section Two to add the following "The 3 acres of public park land shall not be diminished by any <br />private amenity area provided for multi-family residential development" and Mr. Hart seconded <br />the motion. Mr. Patterson suggested the 3 acres be for parkland. On roll call of Mr. <br />Mihalkanin's second amendment, the following vote was recorded: <br />AYE: Mihalkanin, Hart, Moore, Guerra, Cox. <br />NAY: Hernandez. <br />ABSTAIN: Hughson. <br />Mr. Mihalkanin moved to amend Page 3-3, Section Two to add the following "Each land use <br />and/or zoning designation, except parkland areas, can vary by +/-10% provided the overall <br />number of units and traffic volume does not increase" and Mr. Hart seconded the motion. On <br />roll call the following vote was recorded: <br />AYE: Mihalkanin, Hart, Guerra, Cox. <br />NAY: Moore, Hernandez.
