66 <br />Special Meeting December 15, 1997 Page 3 <br />ABSTAIN: Hughson. <br />Mr. Mihalkanin moved to amend Page 3-3, Section Two, to delete the first bullet and replace <br />with the following "The first block of single-family residential homes adjacent to the Oak <br />Heights Neighborhood shall either be of equal density or no lower assessed value" and Mr. Hart <br />seconded the motion. Dr. Weatherford requested the amendment read "... assessed taxable <br />value". Council agreed. Mr. Patterson suggested to lock into a density for clarity. Mr. Isaac <br />stated the neighborhood would be concerned with this amendment because the density allows for <br />six houses per acre. Carol Grimm stated the land use was the discussion in the charrette and the <br />value of the land was not discussed. Mr. Hart asked Mr. Patterson if during the charrette Dr. <br />Weatherford's property was discussed as 3.2 to 4.5. Mr. Patterson stated the property is zoned R- <br />1, which allows six houses per acre. On roll call of Mr. Mihalkanin's amendment, the following <br />vote was recorded: <br />AYE: Mihalkanin, Hart, Moore, Hernandez. <br />NAY: Guerra, Cox. <br />ABSTAIN: Hughson. <br />Mr. Cox moved to amend Page 3-3, Section Two to add the following "Maximum of two <br />roadway access points on Ranch Road 12 and inwardly-oriented commercial development" and <br />Mr. Guerra seconded the motion. Mr. Mihalkanin stated concerns with this putting more traffic <br />into the subdivision. Mr. Cox stated his main concern was the residents on Ranch Road 12 and <br />felt this would be compatible with the new urbanism. On roll call of Mr. Cox's amendment, the <br />following vote was recorded: <br />AYE: Moore, Guerra, Cox. <br />NAY: Mihalkanin, Hart, Hernandez. <br />ABSTAIN: Hughson. <br />Motion fails. Mr. Cox moved to amend Page 3-3, Section Two to add the following "Maintain <br />the existing natural qualities of the site along Ranch Road 12 through the provision of a 25 foot <br />natural vegetation or landscape buffer, except at required road access points" and Mr. Guerra <br />seconded the motion. Dr. Weatherford asked who would be responsible for maintaining the <br />buffer. Mr. Patterson stated the owner of the property would be responsible for the buffer area. <br />The Council then voted unanimously for approval of the amendment. Mr. Cox moved to amend <br />Page 3-3, Section Two to begin by reading "The following guidelines will apply to development <br />of this area:" and Mr. Mihalkanin seconded the motion, which passed unanimously. Mayor <br />Moore asked the Council if they would like to leave the Swart property and the Church property <br />zoned as it currently appears. Council agreed. Mayor Moore asked about Randall Morris' <br />request to revert property back to low density or keep designated as open space. Mr. Cox stated <br />he had a conflict of interest and filed an Affidavit of Disclosure form with the City Secretary and <br />left the Council Chambers. Mr. Taylor explained there is no reason to leave the property as open <br />space if it is not going to be developed as parkland. Mr. Guerra moved to amend the land use for <br />Randall Morris' property to "yellow" (low density) and Mr. Hernandez seconded the motion, <br />which passed unanimously. On roll call for adoption of the Ordinance on third and final reading <br />the following vote was recorded: <br />AYE: Mihalkanin, Hart, Moore, Guerra, Cox, Hernandez. <br />NAY: None. <br />ABSTAIN: Hughson. <br />Mayor Moore introduced a discussion regarding changing the election date for City elections
