Mr. Theriot stated this would require a site plan review and <br />water quality review; however, there were no immediate requirements to pave the property. He <br />stated this has historically been used as a parking area. Mr. Guerra stated this property was <br />denied for commercial use and would like to know the difference between commercial and "LB". <br />Mr. Theriot stated "LB" was retail type usage and not an intensive commercial use. Mr. Hart <br />asked if this was to bring the land use into compliance with its actual use. Mr. Theriot stated that <br />was correct. Terry Baker, resident of Cheatham Street, asked if the "LB" designation would <br />apply to the other end of Rio Vista at the corner of Hopkins and Cheatham. Mr. Hart stated that <br />property is currently zoned "LB" and that area is generally Commercial/LB Zoning. There were <br />no other speakers so Mayor Moore closed the public hearing. Mr. Hernandez moved for <br />adoption of the Zoning Ordinance and Mr. Guerra seconded the motion, which passed <br />unanimously. <br />Mayor Moore introduced for consideration a public hearing and adoption of a Zoning Ordinance, <br />the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING <br />A 1.396 ACRE TRACT OF PROPERTY LOCATED IN THE 300 BLOCK OF <br />STAGECOACH ROAD FROM "TH-2" TOWNHOUSE RESIDENTIAL DISTRICT <br />(MEDIUM DENSITY) TO "C" COMMERCIAL DISTRICT; INCLUDING <br />PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. <br />Mayor Moore opened the public hearing and asked if anyone wished to speak. Joel Barnard, one <br />of the property owners, stated the extended commercial zoning request was for medical <br />professional offices. David Darr, <br />property owner, stated he would answer any questions for the Council. There were no other <br />speakers so Mayor Moore closed the public hearing. Mr. Guerra moved for adoption of the <br />Zoning Ordinance and Mr. Cox seconded the motion. Mr. Guerra asked if the zoning was <br />inclusive of the store and house. Mr. Theriot stated that was correct. Mayor Moore asked about <br />the water line issue. Mr. Gilley stated the water line would have to be moved and that issue <br />would be dealt with in the platting process. Mr. Guerra asked the total cost to extend service to <br />that piece of property. Mr. Gilley stated approximately $25,000. Mr. Hart stated water and <br />sewer were not provided to this piece of property, which is basic service a municipality is <br />obligated to provide. The Council then voted unanimously for adoption of the Zoning <br />Ordinance. <br />Mayor Moore introduced for consideration adoption of an Ordinance on emergency, the caption <br />which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMEND LNG THE CITY BUDGET ORDINANCE FOR THE 1997-1998 <br />FISCAL YEAR TO PROVIDE FUNDING FOR THE POOL RENOVATION AND <br />ADA RENOVATIONS PROJECTS AND DECLARING AN EMERGENCY.
