Manager to execute the contract documents on behalf of the City and declaring an effective <br />date. <br />16. Consider adoption of Resolution 2009-87R, approving a license agreement between the <br />Citv and Walter Erwin, Erwin Properties I, L.P. for use of the area overhanging a portion <br />of the N. LBJ right-of-way in front of Wally's Party Factory; authorizing the Citv Manager <br />to execute the agreement; and declaring an effective date. <br />17. Consider adoption of Resolution 2009-88R, approving the sale of four tracts of property <br />located at 1006, 1008, 1010 and 1012 Gravel Street by the San Marcos Consolidated <br />Independent School District and Hays County, trustees; and declaring an effective date <br />18. Consider adoption of Resolution 2009-89R, confirming the City Manager's <br />appointment of Les Stephens as Chief and head of the San Marcos Fire Department for all <br />lawful purposes, effective August 1, 2009 and until such time as his successor is appointed; <br />and declaring an effective date. <br />19. Consider adoption of Resolution 2009-90R, approving an interlocal agreement to pay <br />Hays County $14,761 upon the City's receipt of a Justice Assistance Grant in the sum of <br />$29,522 to be used for law enforcement purposes; and declaring an effective date <br />Items 13, 14, 16, and 18 were pulled from the Consent Agenda. <br />• MOTION: Upon a motion made by Councilmember Bose and a second by Councilmember <br />Jones, the City Council voted seven (7) for and none (0) opposed, to approve the Consent <br />Agenda, less items 13, 14, 16, and 18. The motion carried unanimously. <br />• <br />(13)MOTION: Upon a motion made by Councilmember Couch and a second by <br />Councilmember Jones, the City Council voted seven (7) for and none (0) opposed, to approve <br />Resolution 2009-84R. The motion carried unanimously. <br />(14)MOTION: Upon a motion made by Councilmember Thomaides and a second by <br />Councilmember Jones, the City Council voted seven (7) for and none (0) opposed, to approve <br />Resolution 2009-85R. The motion carried unanimously. <br />(16)MOTION: Upon a motion made by Councilmember Thomaides and a second by <br />Councilmember Jones, the City Council voted seven (7) for and none (0) opposed, to approve <br />Resolution 2009-87R. The motion carried unanimously. <br />(18)MOTION: Upon a motion made by Councilmember Jones and a second by Councilmember <br />Couch, the City Council voted seven (7) for and none (0) opposed, to approve Resolution 2009- <br />89R.
