Remove from table and consider adoption of Ordinance 2009-31, amending Article 2, • <br />Division 2 of Chapter 86, Water Conservation, of the San Marcos City Code; and providing <br />an effective date. <br />MOTION: Upon a motion made by Councilmember Thomaides and a second by <br />Councilmember Couch, the City Council voted six (6) for and one (1) opposed, with <br />Councilmember Bose voting against, to remove this item from the table. The motion carried. <br />MOTION: Upon a motion made by Councilmember Thomaides and a second by <br />Councilmember Jones, and amended to change the variance period from one year to six months, <br />the City Council voted three (3) for and four (4) opposed, with Councilmembers Thomaides, <br />Bose, Jones and Terry voting against, to adopt Ordinance 2009-31, as previously captioned. The <br />motion failed. <br />21. Consider an ordinance amending the traffic register maintained under Section 82.067 <br />of the San Marcos City Code by amending the speed limits along a section of S.H. 123 in <br />both directions from a point south of Monterey Oaks to the San Marcos south city limits; <br />providing a savings clause; providing that all conflicting ordinances are repealed; and <br />providing an effective date; and consider ordinance on the first of two readings. <br />MOTION: Upon a motion made by Councilmember Couch and a second by Councilmember <br />Thomaides, the City Council voted seven (7) for and none (0) opposed, to approve the ordinance <br />on the first of two readings. The motion carried unanimously. • <br />22. Discussion on engine braking by 18-wheelers within the San Marcos coraorate limits <br />and provide direction to staff. <br />MOTION: Upon a motion made by Councilmember Jones and a second by Councilmember <br />Couch, the City Council voted seven (7) for and none (0) opposed, to table this item until July <br />21. The motion carried unanimously. <br />23. Discussion on City Council policy regarding invocations at Citv Council meetings, and <br />provide direction to staff. <br />Mayor Narvaiz reported that the City Council met in Executive Session to receive legal advice <br />regarding legislative prayer. City Attorney Michael Cosentino reported on the Council's <br />consensus which included: 1) development of a prayer policy to be brought back to Council; 2) <br />to continue having invocations; 3) making the City Clerk responsible for the rotation; 4) having <br />the City Clerk make a concerted effort to include all faiths; and 5) including guidelines that <br />persons offering invocations may not advance or disparage any faith and may not proselytize. <br />MOTION: Upon a motion made by Councilmember Bose and a second by Councilmember <br />Thomaides, the City Council voted seven (7) for and none (0) opposed, to confirm their intent as <br />outlined by the City Attorney.
