(1) removed from <br /> the consensus agenda, adoption of a Resolution, the caption which <br /> was read as follows: <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, APPROVING A PARTIAL RELEASE OF ABSTRACT OF JUDGMENT FOR <br /> PROPERTY AT 410 BROADWAY STREET PURCHASED BY MR. HENRY GARZA; <br /> AUTHORIZING THE CITY MANAGER TO SIGN THE PARTIAL RELEASE OF <br /> ABSTRACT OF JUDGMENT; AND DECLARING AN EFFECTIVE DATE. <br /> Mr. Guerra moved for adoption of the Resolution and Mr. Hart <br /> seconded the motion. Mr. Hart advised he appreciated Mr. Taylor's <br /> efforts in this matter. Mr. Hart stated it is Mr. Garza's intent <br /> to secure financing, and what if the Council does not approve. Mr. <br /> Taylor advised Mr. Garza's financing from Frost Bank would not <br /> occur. Mr. Guerra stated his interest in seeing the location of <br /> this property on a map. Mr. Guerra moved to table this matter to <br /> the next meeting for a location map to be provided and Mr. Cox <br /> seconded the motion, which passed unanimously. <br /> Mayor Moore introduced for consideration Item 9.B. (3) removed from <br /> the consensus agenda, adoption of a Resolution, the caption which <br /> was read as follows: <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, SUPPORTING LEGISLATION FOR THE CREATION OF A COMMUTER <br /> RAIL DISTRICT WITHIN THE IH-35 CORRIDOR; AND DECLARING AN <br /> EFFECTIVE DATE. <br /> Mr. Guerra moved for adoption of the Resolution and Mr. Cox seconded <br /> the motion. Mr. Guerra asked if this authority would have the power <br /> to tax the citizens of San Marcos, and stated the Bexar County <br /> Commissioners had discussed this subject in their recent meeting. <br /> Mr. Taylor stated he would look at this if the Council has concerns. <br /> Mr. Guerra stated he understands this authority will be revenue <br /> based, and wants assurance they cannot ask San Marcos to provide <br /> funding. Mr. Hart stated he will vote against this matter and <br /> referred to Section 2 on Page 11 emergency provision and added this <br /> is a railroad job. Mayor Moore stated this is boiler plate <br /> language. Mayor Moore stated Section 5. (d) on Page 10 regarding <br /> bonds and notes allows for loopholes when the Legislature acts. Ms. <br /> Hughson asked what happens if we approve or do not approve. Mayor <br /> Moore stated it could give us a commuter rail. Ms. Hughson stated <br /> will they go around San Marcos if we don't approve. Mayor Moore <br /> stated there is a fifteen-year time frame involved with this, and is <br /> the City interested in having a commuter rail. If we do ilDt <br /> approve, we will be asked why not by Ross Malloy of the Co~ridor <br />
