76 <br />Regular Meeting April 22- 1996 Page 2 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING <br />A 0.321 ACRE TRACT OF PROPERTY LOCATED AT 712 PEQUES STREET, <br />FROM "P" (PUBLIC DISTRICT) TO "MF-2" (MULTI-FAMILY DISTRICT <br />[MEDIUM DENSITY]); INCLUDING PROCEDURAL PROVISONS; AND <br />PROVIDING FOR PENALTIES. <br />Mayor Morris opened the public hearing and asked if anyone wished to <br />speak. No one did, so Mayor Morris closed the public hearing. <br />Mayor Morris stated she and Randall Morris sold the property to Mr. <br />Keene. She stated she would abstain on this matter to avoid the <br />appearance of conflict and filed an affidavit with the City <br />Secretary. Mr. Moore moved for adoption of.the Zoning Ordinance and <br />Mr. Hart seconded the motion. On roll call the following vote was <br />recorded: <br />AYE: Moore, Mooney, Hart, Guerra, Cox, Hernandez. <br />NAY: None. <br />ABSTAIN: Morris. <br />Mayor Morris introduced for consideration a public faearing and <br />approval of an Ordinance on first reading, the caption which was <br />read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THE FOLLOWING SECTIONS OF THE ZONING CHAPTER OF <br />THE CITY CODE: 114.353 AND 114.368, TO INCREASE THE MINIMUM <br />LOT SIZE IN MF-4 AND MF-5 ZONING DISTRICTS; 114.518 AND <br />114.533, TO INCREASE THE SETBACK REQUIREMENTS IN LI AND I <br />ZONING DISTRICTS; 114.578, TO REVISE CERTAIN REQUIREMENTS <br />REGARDING FRATERNITY/SORORITY SPECIFIC USE PERMITS; AND <br />114.618, TO INCREASE THE MAXIMUM HEIGHT OF FENCES IN <br />RESIDENTIAL SIDE YARDS ADJACENT TO STREETS; INCLUDING <br />PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. <br />Mayor Morris opened the public hearing and asked if anyone wished to <br />speak. Mark Mayhew of Century 21 asked what prompted the amendment <br />regarding MF-4 and MF-5 zoning, and Mr. Patterson responded the <br />Planning and Zoning Commission received several requests for high <br />density on small areas, so they raised the threshold. Mr. Mayhew <br />stated there is very little property in San Marcos zoned MF to work <br />with, and this change will result in higher rent. No one else <br />wished to speak, so Mayor Morris closed the public hearing. Mr. <br />Guerra moved for approval of the Ordinance on first reading and Mr. <br />Moore seconded the motion. Mr. Guerra requested an explanation of <br />the SUP amendments. Mr. Patterson advised the Planning and Zoning <br />Commission wanted to deal with life safety violations separately and <br />wanted parking violations to be an overall condition for the issue <br />of a permit. The amendments presented are in response to concerns <br />expressed in the community, such as the MF high density on small <br />lots. Mr. Patterson stated smaller lots of MF could remain MF as a <br />nonconforming use as long as the square footage is not less than <br />fifty percent of the present lot size requirements. Mr. Hart stated <br />this would eliminate small development projects from occurring, such <br />as four-plexes, and will create new problems. Mr. Moore moved to <br />amend Section 1 (Section 114.353[11a.) from 43,560 square feet to <br />12,000 square feet, and Section 2 (Section 224.368[1]a.) from 43,560 <br />square feet to 20,000 square feet and Mr. Cox seconded the motion. <br />On roll call the following vote was recorded: <br />AYE: Moore, Mooney, Guerra, Cox. <br />NAY: Hart, Morris, Hernandez. <br />ABSTAIN: None.
