77 <br />Regular Meeting April 22, 1996 Page 3 <br />Mr. Hart moved to amend Section 3 (Section 114.518[41) and Section 4 <br />(114.533[4]) for the minimum depth of front setback from 20 feet to <br />10 feet and Mr. Hernandez seconded the motion. On roll call the <br />following vote was recorded: <br />AYE: Hart, Morris, Hernandez. <br />NAY: Moore, Mooney, Guerra, Cox. <br />ABSTAIN: None. <br />The motion failed. Mr. Hart then moved to amend Sections 1 (Section <br />114.353 [1] a. ) and 2 (Section 114.368 [1] a. ) to remain at the current <br />square footage of 6,000 square feet and Mr. Hernandez seconded the <br />motion. On roll call the following vote was recorded: <br />AYE: Hart, Morris, Hernandez. <br />NAY: Moore, Mooney, Guerra, Cox. <br />ABSTAIN: None. <br />The motion failed. Mr. Taylor stated MF4 could still develop as a <br />nonconforming use if the square footage is not less than fifty <br />percent of this requirement, and MF5 will need to consider some <br />other development plan. Mr. Patterson will advise the Council how <br />many lots will be affected by this amendment. On roll call for <br />approval of the Ordinance on first reading, the Council voted <br />unanimously for approval. <br />Mayor Morris introduced for consideration adoption of an Ordinance <br />on emergency, the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THE CITY BUDGET ORDINANCE FOR THE 1995-96 <br />FISCAL YEAR TO PROVIDE FUNDING FOR THE BLANCO STREET DRAINAGE <br />IMPROVEMENTS PROJECT; AND DECLARING AN EMERGENCY. <br />Mr. Moore moved for adoption of the Ordinance on emergency and Mr. <br />Hart seconded the motion, which passed unanimously. <br />Mayor Morris introduced for consideration adoption of an Ordinance <br />on emergency, the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THE CITY BUDGET ORDINANCE FOR THE 1995-96 <br />FISCAL YEAR TO PROVIDE FUNDING FOR THE WILLOW CREEK INTERCEPTOR <br />PROJECT; AND DECLARING AN EMERGENCY. <br />Mr. Moore moved for adoption of the Ordinance on emergency and Mr. <br />Guerra seconded the motion, which passed unanimously. <br />Mayor Morris introduced for consideration adoption of an Ordinance <br />on emergency, the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THE CITY BUDGET ORDINANCE FOR THE 1995-96 <br />FISCAL YEAR TO PROVIDE FUNDING FOR THE WASTEWATER TREATMENT <br />PLANT EXPANSION PROJECT; AND DECLARING AN EMERGENCY. <br />Mr. Moore moved for adoption of the Ordinance on emergency and Mr. <br />Mooney seconded the motion, which passed unanimously. <br />Mayor Morris introduced for consideration adoption of an Ordinance <br />on emergency, the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AUTHORIZING THE ISSUANCE AND SALE OF CITY OF SAN MARCOS, <br />TEXAS, WATERWORKS AND SEWER SYSTEM REVENUE BONDS, SERIES <br />1996-A, IN THE AGGREGATE PRINCIPAL AMOUNT OF $1,500,000; <br />PRESCRIBING THE FORM OF SAID BONDS; PROVIDING FOR THE SECURITY <br />FOR AND PAYMENT OF SAID BONDS; AWARDING THE SALE THEREOF; <br />APPROVING THE OFFICIAL STATEMENT; ENACTING OTHER PROVISIONS <br />RELATING TO THE SUBJECT; AND DECLARING AN EMERGENCY.
