(9) Mayor Moore congratulated Counc~l Member Rick <br />Hernandez for successfully being elected to the National Lea~ue of Cities <br />Board of Directors. <br /> <br />Mayor Moore introduced for consideration approval of one appointment to <br />the Drainage Advisory Board. Mr. Moseley did not have a nomination and <br />this matter will be rescheduled for the next meeting. <br /> <br />Mayor Moore introduced for consideration approval of one appointment to <br />complete a vacancy on the Cemetery Commission. Mr. Mihalkanin moved to <br />appoint Sara Kirkpatrick of Wimberley and Ms. Hughson moved to appoint Sue <br />Nix of San Marcos. On roll call the following vote was recorded: <br /> <br />KIRKPATRICK: Mihalkanin, Doiron, Moore, Moseley, Cox, Hernandez. <br /> <br />NIX: Hughson. <br /> <br />Ms. Kirkpatrick will complete the vacancy on the Cemetery Commission. <br /> <br />Mayor Moore introduced for consideration a public hearing and adoption of <br />a Zoning Ordinance, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 30.66 ACRE <br />TRACT OF PROPERTY LOCATED AT THE INTERSECTION OF BISHOP STREET AND <br />RANCH ROAD 12, FROM "R-1" (SINGLE-FAMILY DWELLING DISTRICT [LOW <br />DENSITY]) TO "PD~ (PLANNED DEVELOPMENT DISTRICT); INCLUDING <br />PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. <br /> <br />Mayor Moore opened the public hearing and asked if anyone wished to speak. <br />Charles Soechting, representing Jack Weatherford, advised this matter has <br />been an emotional issue and acknowledged that many present were opposed to <br />this rezoning. He stated Dr. Weatherford purchased this property in 1961 <br />for the purpose of developing it. He stated the Council approved a <br />charrette process, and the development has now been fine tuned for two <br />years and one month. He stated there have been two concerns raised: <br />Amount of parking and a tree survey which are the two variances requested, <br />and the variances were determined on November 6. He stated Dr. <br />Gilcrease's adjoining property will serve as an extension of Hughson Drive <br />and the parking issue is resolved with the addition of Dr. Gilcrease's <br />property. The tree concern will be addressed December 17. He requested <br />the Council vote to send this matter to the Planning and Zoning Commission <br />for fine tuning. He stated Dr. Weatherford continues in good faith and <br />appreciates the neighbors' concerns. He again requested the Council send <br />this matter back to the Planning and Zoning Commission to ultimately get a <br />favorable recommendation. Amelia Harris stated she has property next to <br />Dr. Gilcrease's property and is opposed to this zoning change. She has <br />counted 1,200 cars in an hour, four deer killed in one week and witnessed <br />two accidents. She stated this development would create 200 additional <br />cars per hour. She stated she wants the Council to think logically and <br />stated the Council will be responsible for traffic accidents. This zoning <br />allowing multi-family will devalue property and asked the Council to vote <br />no. Camille Phillips stated she asked the Council to consider the <br />charrette and now requests the Council to deny this zoning request. She <br />stated Dr. Weatherford has requested this matter be returned to the <br />Planning and Zoning Commission, but yet he chose to go through the <br />process. She stated this type development does not need to be built over <br />the Aquifer, and this property needs to stay zoned R-1. She requested the <br />Council deny this zoning request. John McBride stated he lives at 703 <br />Franklin and stated he does not want the Council to approve the zoning <br />request or send the matter back to the Planning and Zoning Commission. He <br />stated multi-family zoning would allow too much development in this area <br />and stated development is a gamble, not an unlimited right. Dean Lodge <br />who has resided at 109 Hughson Drive since 1974 stated he is not opposed <br />to R-1 development. He stated traffic and infrastructure is a problem in <br />
