Mr. Gilley stated we <br />have been working for more than 1-1/2 years on this matter and if the <br />Council has legal concerns, he understands the need to delay the matter <br />for another week. Mr. Gilley stated it would not be on the agenda if Mr. <br />Knight's work was not in order. Mr. Moseley rescinded his second to Mr. <br />Hernandez's motion. Mr. Doiron then moved for adoption of the Ordinance <br />on emergency and Mr. Cox seconded the motion, which passed unanimously <br />(Ms. Hughson abstaining and not present to vote on this matter). <br /> <br />Mayor Moore introduced for consideration adoption of an Ordinance on <br />emergency, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY OF SAN MARCOS VACATING AND ABANDONING <br />EASEMENTS; AUTHORIZING A RELEASE OF EASEMENTS TO BE EXECUTED AND <br />RECORDED BY THE CITY; AUTHORIZING A TEMPORARY ROADWAY EASEMENT; <br />DEDICATING 0.160 ACRES OF PUBLIC RIGHT-OF-WAY; MAKING FINDINGS OF <br />FACT; AND PROVIDING FOR RELATED MATTERS. <br /> <br />(Ms. Hughson filed an affidavit of disclosure with the City Secretary and <br />left the Council Chambers. Mr. Taylor filed an affidavit of disclosure <br />with the City Secretary and left the Council Chambers.). Mr. Doiron moved <br />for adoption of the Ordinance on emergency and Mr. Moseley seconded the <br />motion, which passed unanimously (Ms. Hughson abstaining and not present <br />to vote on this matter). <br /> <br />Mayor Pro-Tern Mihalkanin introduced for consideration approval of an <br />Ordinance on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING SECTION 2.371 OF THE CITY CODE TO UPDATE THE SCHEDULE OF <br />EMPLOYEE CLASSIFICATIONS; AND INCLUDING PROCEDURAL PROVISIONS. <br /> <br />Mr. Doiron moved for approval of the Ordinance on first reading and Ms. <br />Hughson seconded the motion. Mr. Hernandez stated there was not much <br />backup on this matter. Mr. Gilley stated this adds classifications for <br />the electric utility department and a Grade 49 exempt classification for <br />the deputy city manager position. Mr. Gilley stated he would bring <br />additional information to the Council at second reading. The Council then <br />voted unanimously for approval of the Ordinance on first reading (Messrs. <br />Doiron and Moore not present to vote on this item). <br /> <br />Mayor Moore introduced for consideration approval of an Ordinance on <br />second reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING ARTICLE 2, MASTER PLAN, OF CHAPTER 102, PLANNING, OF THE <br />CITY CODE TO AMEND THE SAN MARCOS HORIZONS CITY MASTER PLAN ADOPTED <br />IN SECTION 102.026 BY ADOPTING A NEW CHAPTER 4, ANNEXATION; INCLUDING <br />PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. <br /> <br />Mr. Moseley moved for approval of the Ordinance on second reading and to <br />amend to include the new Annexation Map and Ms. Hughson seconded the <br />motion, which passed unanimously. <br /> <br />Mayor Moore introduced for consideration reconsideration of a Zoning <br />Ordinance. The Council did not wish to reconsider the Zoning Ordinance. <br />The caption reads as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 2.86 ACRE <br />TRACT OF PROPERTY LOCATED AT 1631 AQUARENA SPRINGS DRIVE, FROM "C" <br />(COMMERCIAL DISTRICT) TO "MF-5" (MULTI-FAMILY DWELLING DISTRICT [HIGH <br />DENSITY]); INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR <br />PENALTIES. <br />
