111 <br />Regular Meeting April 13, 1998 Page 2 <br />Mayor Moore introduced for consideration a public hearing and adoption of a Zoning Ordinance, <br />the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SA-Ni MARCOS, <br />TEXAS, AMENDD?G THE OFFICIAL ZONING MAP OF THE CITY BY REZONING <br />A ONE ACRE TRACT OF PROPERTY LOCATED AT 2108 IH-35 NORTH FROM <br />"R-1" SINGLE-FAMILY DWELLING DISTRICT (LOW DENSITY) TO "C" <br />COMMERCIAL DISTRICT; INCLUDING PROCEDURAL PROVISIONS; AND <br />PROVIDING FOR PENALTIES. <br />Mr. Hart stated he had this property under contract and would be abstaining from the discussion. <br />Mayor Moore opened the public hearing and asked if anyone wished to speak. There were no <br />speakers so Mayor Moore closed the public hearing. Mr. Hernandez moved for adoption of the <br />Zoning Ordinance and Mr. Mihalkanin seconded the motion. On roll call the following vote was <br />recorded: <br />AYE: Mihalkanin, Hughson, Moore, Hernandez. <br />NAY: None. <br />ABSTAIN: Hart. <br />Mayor Moore introduced for consideration a public hearing and adoption of an Ordinance on <br />emergency, the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, DESIGNATING A REINVESTMENT ZONE NO. 11 PURSUANT TO <br />CHAPTER 312 OF THE TEXAS TAX CODE CONSISTING OF 21.535 ACRES OF <br />PROPERTY LOCATED ADJACENT TO THE 1000-1100 BLOCKS OF THORPE <br />LANE AND THE 100-500 BLOCKS OF SPRINGTOWN WAY, COMMONLY <br />KNOWN AS SPRINGTOWN CENTER, MAKING STATUTORY FINDINGS; AND <br />DECLARING AN EMERGENCY. <br />Mayor Moore opened the public hearing and asked if anyone wished to speak. There were no <br />speakers so Mayor Moore closed the public hearing. Mr. Mihalkanin asked why this was an <br />emergency. Mr. Gilley stated it was a timing issue. Mr. Hart stated he feels Target has made a <br />retail decision to locate here and thinks we would be taking advantage of the tax abatement <br />process to grant this abatement. Mr. Hart stated he sees it as a market driven decision and does <br />not feel a tax abatement is needed. Mr. Hernandez stated he sees Mr. Hart's viewpoint, however, <br />he thinks this is an important area of town to have buildings filled and create jobs. Mr. Hart <br />stated he felt this would bring minimum skill jobs and that is not the incentive of the tax <br />abatement policy. The Council agreed by common consent to delay this issue until later in the <br />evening. <br />Mayor Moore introduced for consideration a public hearing and adoption of a Resolution, the <br />caption which was read as follows: <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING RESOLUTION 1997-104R WHICH APPROVED THE <br />ALLOCATION OF 1997 COMMUNITY DEVELOPMENT BLOCK GRANT <br />FUNDING TO REALLOCATE FUNDS FROM PHASE III OF THE DOWNTOWN <br />SIDEWALK PROJECT TO THE VICTORY GARDENSIWALLACE STREET <br />OVERLAY PROGRAM AND THE HILLS OF HAYS PARK PROJECT; AND <br />DECLARING AN EFFECTIVE DATE. <br />Mayor Moore opened the public hearing and asked if anyone wished to speak. There were no <br />speakers so Mayor Moore closed the public hearing. Mr. Hart moved for adoption of the <br />Resolution and Mr. Hernandez seconded the motion.
