Regular Meeting November 23, 1998 Page 5 The motion failed. Ms. Hughson moved to amend the Resolution in PART 5.D. to receive updates monthly and those be provided to Council. There was no second and the motion failed. On roll call for adoption of the Resolution, the following vote was recorded: AYE: Mihalkanin, Hughson, Moore, Moseley, Cox. NAY: Doiron, Hernandez. ABSTAIN: None. Mr. Hernandez is opposed to this Resolution because of the 7:00 p.m. meeting time. Mayor Moore introduced for consideration Item 8.D.(2) removed from the consent agenda, adoption of a Resolution, the caption which was read as follows: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, GRANTING A PIPELINE EASEMENT ACROSS THE SURFACE WATER TREATMENT PLANT PROPERTY TO THE GUADALUPE-BLANCO RIVER AUTHORITY; AUTHORIZING THE CITY MANAGER TO EXECUTE THE EASEMENT; AND DECLARING AN EFFECTIVE DATE. Mr. Hernandez moved for adoption of the Resolution and Ms. Hughson seconded the motion, which passed unanimously (Mayor Moore not present to vote on this item). Mayor Moore introduced for consideration Item 8.D.(4) removed from the consent agenda, adoption of a Resolution, the caption which was read as follows: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS OF A DEVELOPMENT INCENTIVE AGREEMENT BETWEEN THE CITY AND LEGEND COMMUNITIES, INC. D/B/A/ SDC AUSTIN COMMUNITIES FOR A PROPOSED SUBDIVISION DEVELOPMENT ADJACENT TO THE CASTLE FOREST SUBDIVISION; AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT; AND DECLARING AN EFFECTIVE DATE. Mr. Hernandez moved for adoption of the Resolution and Ms. Hughson seconded the motion. The new road will realign Bishop Street. The development will be totally R-1. Haythem Dawlett advised the Council the development will be for medium family income withhold in the range of $78,000-$100,000. Ms. Hughson asked if this was in the contract and Mr. Taylor said no. Ms. Hughson said it will have to be in the contract to receive her approval. The Council also expressed concern regarding the affordable housing issue. Mr. Mihalkanin moved to table the Resolution and Mr. Moseley seconded the motion. The motion and second were then withdrawn. Mr. Taylor reviewed the following amendments with the Council. (1) On Page 2, Item 2.B., change the deadline date for completion of first phase of construction from October 31, 1999 to December 31, 1999. (2) On Page 3, the second full sentence, change timing of deposit of funds from "upon execution of agreement" to "upon notification by the Developer that construction of the realignment is to commence". (3) On Page 4, Item 7, address is changed for notice to Developer. Mr. Hernandez moved to amend the Resolution to include these three amendments and Mr. Doiron seconded the motion. On roll call the following vote was recorded: 211 AYE: Mihalkanin, Doiron, Moore, Moseley, Cox, Hernandez.
