212 <br />Regular Meeting November 23, 1998 Page 6 <br />NAY: Hughson. <br />ABSTAIN: None. <br />Mr. Mihalkanin moved to table the Resolution for additional <br />amendment to`the agreement and Mr. Moseley seconded the motion, <br />which passed unanimously (See Page 7). <br />Mayor Moore introduced for consideration Item 8.D.(5) removed <br />from the consent agenda, adoption of a Resolution, the caption <br />which was read as follows: <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, RESCINDING THE SALE OF ALL OF A PORTION OF LOT 8, <br />BLOCK 8, D. S. COMBS ADDITION TO EMILY MCKNIGHT; AND <br />DECLARING AN EFFECTIVE DATE. <br />Ms. Hughson moved for adoption of the Resolution and Mr. <br />Hernandez seconded the motion, which passed unanimously. <br />Mayor Moore introduced for consideration Item 8.D.(7) removed <br />from the consent agenda, adoption of a Resolution, the caption <br />which was read as follows: <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING AN AGREEMENT BETWEEN THE CITY AND GEORGE <br />W. MEURY SERVICES, INC. FOR PROFESSIONAL SURVEYING SERVICES <br />IN CONNECTION WITH EASEMENT ACQUISITION FOR THE SURFACE <br />WATER TREATMENT PLANT TRANSMISSION LINE PROJECT AND THE <br />GARY JOB CORPS FORCE MAIN PROJECT; AUTHORIZING THE CITY <br />MANAGER TO EXECUTE THIS AGREEMENT ON BEHALF OF THE CITY; <br />AND DECLARING AN EFFECTIVE DATE. <br />Mr. Hernandez moved for adoption of the Resolution and Ms. <br />Hughson seconded the motion. Ms. Hughson moved to amend the <br />Agreement to add the following sentence at the end of Section <br />9.8, "However, Surveyor may use the information gathered in the <br />course of this Project with prior written permission from the <br />City and such permission shall not be unreasonably withheld," <br />and Mr. Cox seconded the motion, which passed unanimously. The <br />Council then voted unanimously for adoption of the Resolution. <br />Mayor Moore introduced for consideration Item 8.D.(8) removed <br />from the consent agenda, adoption of a Resolution, the caption <br />which was read as follows: <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING FLOOD MITIGATION ASSISTANCE PROGRAM <br />GUIDELINES; AND DECLARING AN EFFECTIVE DATE. <br />Ms. Hughson moved for adoption of the Resolution and Mr. <br />Mihalkanin seconded the motion. Ms. Hughson moved to amend the <br />section entitled "Persons Eligible to Receive Flood Mitigation <br />Assistance" in 1. to add October 17, 1998, flood delete the <br />second bullet and the first word of the second bullet (provide) <br />and add the word and at the end of the second bullet, and Mr. <br />Mihalkanin seconded the motion, which passed unanimously. Ms. <br />Hughson moved to amend 3. in the same section to add the word <br />and at the end of the first two bullets, in the section entitled <br />"Eligible Costs covered under the Flood Mitigation Assistance <br />Program" in 1. to read, "Costs associated with raising the . . . <br />.", and in the section entitled "Notification of Assistance and <br />Disbursements in 3. to add the following language at the end of <br />the second bullet, after providing proof of work completed, and
