Regular Meeting November 23, 1998 Page 7 <br />Mr. Mihalkanin seconded the motion, which passed unanimously. <br />In the section entitled "Maximum Flood Mitigation Assistance <br />Available Per House" Ms. Hughson moved to amend 7. and there was <br />no second. Ms. Hughson moved to amend the same section in the <br />"Note" to delete All applications will be considered on a first <br />come - first served basis, and Mr. Doiron seconded the motion, <br />which passed unanimously. Ms. Hughson moved to amend the first <br />section entitled "Persons Eligible to Receive Flood Mitigation <br />Assistance to add "4. Preference shall be given to homes that <br />are owner-occupied," and Mr. Doiron seconded the motion, which <br />passed unanimously. The Council expressed concern with the use <br />of funding from the sidewalk project. Mr. Gilley advised Phase <br />II funding is still in place, and the flood mitigation funding <br />is from Phase III. The Council cannot commit future CDBG funds <br />without public hearings, etc., and the Council made note they <br />are committed to the sidewalk project when it is appropriate to <br />commit. The Council then voted unanimously for adoption of the <br />Resolution. <br />Mr. Mihalkanin moved to remove Item 8.D.(4) from the table, <br />adoption of a Resolution, the caption which reads as follows: <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING THE TERMS AND CONDITIONS OF A DEVELOPMENT <br />INCENTIVE AGREEMENT BETWEEN THE CITY AND LEGEND <br />COMMUNITIES, INC. D/B/A SDC AUSTIN COMMUNITIES FOR A <br />PROPOSED SUBDIVISION DEVELOPMENT ADJACENT TO THE CASTLE <br />FOREST SUBDIVISION; AUTHORIZING THE CITY MANAGER TO EXECUTE <br />THE AGREEMENT; AND DECLARING AN EFFECTIVE DATE. <br />Mr. Doiron seconded the motion, which passed unanimously. Mr. <br />Mihalkanin then moved for adoption of the Resolution and to <br />amend the Agreement in Section 3.A. in the first sentence to <br />insert after the first comma, "and the agreement by the <br />Developer that homes in the Project will have an initial selling <br />price between $78,000 and $100,000," and in Section 4.C. in the <br />first sentence to insert before the first comma, "for a default, <br />including the initial sale of any home in the subdivision for a <br />price exceeding $100,000," and Ms. Hughson seconded the motion, <br />which passed unanimously. <br />Mayor Moore introduced a presentation regarding the status of <br />the proposed Commuter Rail Service for Central Texas. <br />Pete Hackley advised the Council a Steering Committee is forming <br />to support a commuter rail service in Central Texas. He stated <br />the Corridor has 2.5 million people in a 100-mile area. The <br />increasing growth of population to our area is a problem. <br />Additionally 100,000 monthly enter Laredo and 75% travel on <br />IH35. Pollution, public safety, quality of life and economic <br />development are additional factors to consider. Mr. Hackley <br />stated a commuter rail runs on railroad tracks, has few stops <br />and serves education, special events, attractions and shopping. <br />Existing tracks will be utilized where they can be. The San <br />Marcos Station possibly might be located at Bobcat Stadium. Mr. <br />Hackley stated Union Pacific is cooperating with the study. <br />They are concerned about their existing customers, they now have <br />limited capacity, any changes must not reduce their efficiency <br />or cost them more. The SH130 Project wants to reroute freight <br />trains and design as a multi-modal corridor. The operating <br />plans are to have the first train at 6:00 a.m. and the last <br />train at 11:00 p.m. and to have special events trains. The Rush <br />Hour Schedule proposals include San Antonio to New Braunfels <br />every 30 minutes, Georgetown and Austin and San Marcos every 30 <br />213
