Regular Meeting August 13, 2001 Page 5 Mayor Chiu introduced for consideration a public hearing and adoption of a Zoning Ordinance, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING LOT 2 OF THE RIVER PUB SUBDIVISION, LOCATED AT 302 RIVERSIDE DRIVE, FROM "C" (COMMERCIAL DISTRICT) TO "R-1" (SINGLE-FAMILY DWELLING DISTRICT [LOW DENSITY]); INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. Mayor Chiu opened the public hearing and asked if anyone wished to speak. Frank Gomillion of Jeff Kester and Associates, stated they are representing the owner of the property who wants to place a cottage on the property. Dianne Wassenich stated this property has been owned by many generations of the same family, that the applicants have made a number of requested changes and she is supportive of this zoning change. No one else wished to speak, so Mayor Chiu closed the public hearing. Mr. Mayhew moved for adoption of the Zoning Ordinance and Ms. Hughson seconded the motion, which passed unanimously. Mayor Chiu introduced for consideration a public hearing and adoption of a Zoning Ordinance, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 10.86 ACRE TRACT OF PROPERTY LOCATED IN THE 2400 BLOCK OF IH35 NORTH, FROM "R-1" (SINGLE-FAMILY DWELLING DISTRICT [LOW DENSITY]) AND "PD" (PRE- DEVELOPMENT DISTRICT) TO "C" (COMMERCIAL DISTRICT); INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. Mayor Chiu opened the public hearing and asked if anyone wished to speak. No one did, so Mayor Chiu closed the public hearing. Ms. Hughson moved for adoption of the Zoning Ordinance and Mr. Mihalkanin seconded the motion. Ms. Hughson stated that the Development Ordinance Task Force requested that the Blanco River be included in the River Corridor Ordinance, along with a number of other changes such that the Ordinance is a Watershed Protection Ordinance. She asked that this particular item be moved promptly through the development ordinance update process. Mr. Montoya stated he is concerned with commercial zoning along the river. Ms. Hughson stated until the City has protection in place for the Blanco River, she is not comfortable with the Commercial zoning on this property. On roll call the following vote was recorded: AYE: Chiu. NAY: Mihalkanin, Montoya, Hughson, Mayhew, Tatum.
