<br />136. <br /> <br />Regular Meeting <br /> <br />August 13, 2001 <br /> <br />Page 5 <br /> <br />Mayor Chiu introduced for consideration a public hearing and adoption of a <br />Zoning Ordinance, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING LOT 2 OF THE <br />RIVER PUB SUBDIVISION, LOCATED AT 302 RIVERSIDE DRIVE, FROM "C" <br />(COMMERCIAL DISTRICT) TO "R-1" (SINGLE-FAMILY DWELLING DISTRICT [LOW <br />DENSITY]); INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR <br />PENALTIES. <br /> <br />Mayor Chiu opened the public hearing and asked if anyone wished to speak. <br />Frank Gomillion of Jeff Kester and Associates, stated they are <br />representing the owner of the property who wants to place a cottage on the <br />property. Dianne Wassenich stated this property has been owned by many <br />generations of the same family, that the applicants have made a number of <br />requested changes and she is supportive of this zoning change. No one <br />else wished to speak, so Mayor Chiu closed the public hearing. Mr. Mayhew <br />moved for adoption of the Zoning Ordinance and Ms. Hughson seconded the <br />motion, which passed unanimously. <br /> <br />Mayor Chiu introduced for consideration a public hearing and adoption of a <br />Zoning Ordinance, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 10.86 ACRE <br />TRACT OF PROPERTY LOCATED IN THE 2400 BLOCK OF IH35 NORTH, FROM "R-1" <br />(SINGLE-FAMILY DWELLING DISTRICT [LOW DENSITY]) AND "PD" (PRE- <br />DEVELOPMENT DISTRICT) TO "C" (COMMERCIAL DISTRICT); INCLUDING <br />PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. <br /> <br />Mayor Chiu opened the public hearing and asked if anyone wished to speak. <br />No one did, so Mayor Chiu closed the public hearing. Ms. Hughson moved <br />for adoption of the Zoning Ordinance and Mr. Mihalkanin seconded the <br />motion. Ms. Hughson stated that the Development Ordinance Task Force <br />requested that the Blanco River be included in the River Corridor <br />Ordinance, along with a number of other changes such that the Ordinance is <br />a Watershed Protection Ordinance. She asked that this particular item be <br />moved promptly through the development ordinance update process. Mr. <br />Montoya stated he is concerned with commercial zoning along the river. <br />Ms. Hughson stated until the City has protection in place for the Blanco <br />River, she is not comfortable with the Commercial zoning on this property. <br />On roll call the following vote was recorded: <br /> <br />AYE: <br /> <br />Chiu. <br /> <br />NAY: <br /> <br />Mihalkanin, Montoya, Hughson, Mayhew, Tatum. <br /> <br />Mayor Chiu introduced for consideration a public hearing and adoption of a <br />Zoning Ordinance, the caption which was read as follows: <br />
