<br />137. <br /> <br />Regular Meeting <br /> <br />August 13, 2001 <br /> <br />Page 6 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 33.582 <br />ACRE TRACT OF PROPERTY LOCATED IN THE 2400 BLOCK OF IH35 NORTH, FROM <br />"R-1" (SINGLE-FAMILY DWELLING DISTRICT [LOW DENSITY]) AND "PD" (PRE- <br />DEVELOPMENT DISTRICT) TO "C" (COMMERCIAL DISTRICT); INCLUDING <br />PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. <br /> <br />Mayor Chiu opened the public hearing and asked if anyone wished to speak. <br />Steve Ramsey was present representing the owner of the property. He <br />stated the Planning and Zoning Commission unanimously recommended the <br />zoning. He stated there is considerable buffer on this property, and the <br />owner is interested in dedicating parkland. No one else wished to speak, <br />so Mayor Chiu closed the public hearing. Mr. Mayhew moved for adoption of <br />the Zoning Ordinance and Ms. Tatum seconded the motion. Mr. Montoya asked <br />how the City goes about the dedication of parkland. Mr. Gilley stated <br />Staff can work with the landowner to accomplish that as this property <br />moved through the platting process. Mr. Taylor advised of the PDD zoning <br />designation as an option. Ms. Hughson stated the parkland information <br />could be passed on to Mr. Patterson and the Planning and Zoning Commission <br />can further discuss this. The Council then voted unanimously for adoption <br />of the Zoning Ordinance. <br /> <br />Mayor Chiu introduced for consideration a public hearing and adoption of a <br />Resolution, the caption which was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />RATIFYING A GRANT APPLICATION TO THE BUREAU OF JUSTICE ASSISTANCE FOR <br />A LOCAL LAW ENFORCEMENT BLOCK GRANT; APPROVING A GRANT CONTRACT WITH <br />THE BUREAU OF JUSTICE ASSISTANCE FOR A LOCAL LAW ENFORCEMENT BLOCK <br />GRANT; APPROVING THE CONTRIBUTION OF MATCHING FUNDS BY THE CITY AND <br />AUTHORIZING THE CITY MANAGER TO EXECUTE ALL GRANT RELATED DOCUMENTS <br />ON BEHALF OF THE CITY; AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mayor Chiu opened the public hearing and asked if anyone wished to speak. <br />No one did, so Mayor Chiu closed the public hearing. Ms. Hughson moved <br />for adoption of the Resolution and Ms. Tatum seconded the motion, which <br />passed unanimously. <br /> <br />Mayor Chiu introduced for consideration approval of an Ordinance on first <br />reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING THE CITY BUDGET ORDINANCE FOR THE 2000-2001 FISCAL YEAR TO <br />PROVIDE FUNDING FOR HEART DEFIBRILLATORS AND A FIREFIGHTER STATUE; <br />AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Mayhew moved for approval of the Ordinance on first reading and Ms. <br />Tatum seconded the motion, which passed unanimously. <br />
