• 19. Consider adoption of Ordinance 2009-49, on emergency, amending Section 8 of <br />Ordinance No. 2009-46 ordering a general election to be held on November 3, 2009 for the <br />purpose of electing a City Council Member, Place 5, and a City Council Member, Place 6 <br />by setting the hours of 7:00 a.m. to 7:00 p.m. for early voting by personal appearance on <br />Monday, October 19, 2009 and on Monday, October 26, 2009 and declaring an emergency. <br />MOTION: Upon a motion made by Councilmember Bose and a second by Councilmember <br />Porterfield, the City Council voted five (5) for and none (0) opposed, to adopt Ordinance 2009- <br />49, on emergency, as previously captioned. The motion carried unanimously. <br />20. Consider adoption of Ordinance 2009-50, on emergency, re-appointing John P. Burke, <br />Jr. for a two year term as Presiding Judge of the Municipal Court of Record in San <br />Marcos, Texas and reappointing Dr. Vincent Luizzi for a two year term as Associate Judge <br />of the Court; providing an effective date; and declarine an emergency. <br />MOTION: Upon a motion made by Councilmember Bose and a second by Councilmember <br />Terry, the City Council voted five (5) for and none (0) opposed, to adopt Ordinance 2009-50, on <br />emergency, as previously captioned. The motion carried unanimously. <br />21. Consider adoption of Resolution 2009-I11R, approving an employment agreement with <br />John P. Burke, Jr. for the position of Presiding Judge of the Municipal Court of Record in <br />San Marcos, Texas; authorizing Mayor Susan Narvaiz to execute the agreement; and <br />• declaring an effective date. <br />MOTION: Upon a motion made by Councilmember Thomaides and a second by <br />Councilmember Bose, the City Council voted five (5) for and none (0) opposed, to adopt <br />Resolution 2009-111R, as previously captioned. The motion carried unanimously. <br />22. Consider adoption of Ordinance 2009-51 on emergency, adopting a budget for the fiscal <br />year beeinning on October 1, 2009 and ending on September 30, 2010; authorizing certain <br />adjustments to the budeet with the approval of the City Manaeer; approvine Fiscal Year <br />2009-2010 Capital Improvements Proeram projects; including procedural provisions; and <br />declarine an emergency. <br />MOTION: Upon a motion made by Councilmember Thomaides and a second by <br />Councilmember Terry, the City Council voted five (5) for and none (0) opposed, to adopt <br />Ordinance 2009-51, on emergency, as previously captioned; and to utilize the unexpended funds <br />in the current budget to fund the Village Main request of $500,000. The motion carried <br />unanimously. <br />23. Consider ratification of the tax rate reflected in the proposed budeet which will raise <br />more revenue from property taxes than in the previous fiscal year. <br />MOTION: Upon a motion made by Councilmember Bose and a second by Councilmember <br />• Thomaides, the City Council voted five (5) for and none (0) opposed, to ratify the tax rate <br />RM090109 Minutes Page 5
