• 19. Consider adoption of Ordinance 2009-49, on emergency, amending Section 8 of Ordinance No. 2009-46 ordering a general election to be held on November 3, 2009 for the purpose of electing a City Council Member, Place 5, and a City Council Member, Place 6 by setting the hours of 7:00 a.m. to 7:00 p.m. for early voting by personal appearance on Monday, October 19, 2009 and on Monday, October 26, 2009 and declaring an emergency. MOTION: Upon a motion made by Councilmember Bose and a second by Councilmember Porterfield, the City Council voted five (5) for and none (0) opposed, to adopt Ordinance 2009- 49, on emergency, as previously captioned. The motion carried unanimously. 20. Consider adoption of Ordinance 2009-50, on emergency, re-appointing John P. Burke, Jr. for a two year term as Presiding Judge of the Municipal Court of Record in San Marcos, Texas and reappointing Dr. Vincent Luizzi for a two year term as Associate Judge of the Court; providing an effective date; and declarine an emergency. MOTION: Upon a motion made by Councilmember Bose and a second by Councilmember Terry, the City Council voted five (5) for and none (0) opposed, to adopt Ordinance 2009-50, on emergency, as previously captioned. The motion carried unanimously. 21. Consider adoption of Resolution 2009-I11R, approving an employment agreement with John P. Burke, Jr. for the position of Presiding Judge of the Municipal Court of Record in San Marcos, Texas; authorizing Mayor Susan Narvaiz to execute the agreement; and • declaring an effective date. MOTION: Upon a motion made by Councilmember Thomaides and a second by Councilmember Bose, the City Council voted five (5) for and none (0) opposed, to adopt Resolution 2009-111R, as previously captioned. The motion carried unanimously. 22. Consider adoption of Ordinance 2009-51 on emergency, adopting a budget for the fiscal year beeinning on October 1, 2009 and ending on September 30, 2010; authorizing certain adjustments to the budeet with the approval of the City Manaeer; approvine Fiscal Year 2009-2010 Capital Improvements Proeram projects; including procedural provisions; and declarine an emergency. MOTION: Upon a motion made by Councilmember Thomaides and a second by Councilmember Terry, the City Council voted five (5) for and none (0) opposed, to adopt Ordinance 2009-51, on emergency, as previously captioned; and to utilize the unexpended funds in the current budget to fund the Village Main request of $500,000. The motion carried unanimously. 23. Consider ratification of the tax rate reflected in the proposed budeet which will raise more revenue from property taxes than in the previous fiscal year.
